WHEREAS, the City Council of the City of Decatur, after due and careful consideration, has <br /> concluded that the annexation of the Subject Property to the City would further the orderly growth <br /> of the City, enable the City to control the development of the Subject Property, and serve the best <br /> interests of the City; and, <br /> WHEREAS, any fire protection district, library district and other entity or person entitled to <br /> notice prior to annexation of the Subject Property to the City has been given notice thereof by the <br /> City; and, <br /> WHEREAS, all public hearings required by law prior to the adoption of any provision of this <br /> Agreement have been held; and, <br /> WHEREAS,the City agrees that the terms and conditions, as contained herein, are reasonable <br /> and acceptable. <br /> NOW, THEREFORE, for and in consideration of the mutual promises and obligations <br /> made and assumed herein, and pursuant to the authority of 65 ILCS 5/11-15.1-1 et seq.,the City and <br /> McLeod agree as follows: <br /> Section 1. The parties enter into this Agreement pursuant to and in accordance with the <br /> applicable provisions of the Illinois Municipal Code, 65 ILCS 5/11-et.seq, and the Codes and <br /> Ordinances of the City. <br /> Section 2. A Petition for Annexation of the Subject Property shall be filed with the City by <br /> McLeod no later than February 25, 2025 in compliance with 65 ILCS 5/7-1-8, said petition to <br /> describe the Subject Property and to request that the same be annexed to and included within the <br /> corporate limits of the City. <br /> Section 3. The City hereby waives any requirement otherwise applicable that McLeod pay to <br /> the City any fee for filing the petition referred to in Section 1 hereof. <br /> Section 4. That upon receipt of said annexation petition, the City shall annex the Subject <br /> Property to the City as provided by law. <br /> Section 5. As an express condition of this Agreement,the City hereby agrees that the maximum <br /> 2 <br />
