RESOLUTION NO. 1353 0 <br /> RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR <br /> FARIES PARKWAY CONCRETE PATCHING <br /> CITY PROJECT 2025-36 <br /> WHEREAS, the City is a municipal corporation as set forth in the Illinois Municipal Code, <br /> 65 ILCS 5/1-1-1 et. seq.; and, <br /> WHEREAS. the City is a home rule unit under Article VII Section 6(a) of the Illinois <br /> Constitution [IL Const. 1970, Art. VII, Section 6(a)]; and, <br /> WHERAS, City currently in process of constructing a new grade separation structure and <br /> relocating a grade crossing on and near Brush College Road ("Brush College Project"); and. <br /> WHEREAS, William Charles Construction ("Contractor") is currently performing work on <br /> the Brush College Project including concrete work; and, <br /> WHEREAS, City is in need of Class B concrete patch work on Faries Parkway, west of <br /> Brush College Road ("Patch Project"); and, <br /> WHEREAS, Contractor has obtained railroad permits and flagger as part of Brush College <br /> Project eliminating costs of additional permits and naggers to work on property adjacent to the <br /> railway property; and. <br /> WHEREAS, the Patch Project Area is currently closed to traffic as a result of the Brush <br /> College Project and falls within Contractor's existing area of responsibility for traffic control; and, <br /> WHEREAS, Contractor is mobilized currently in area of Patch Project and can perform <br /> work in Patch Project area without additional costs of mobilization; and, <br /> WHEREAS, as a result of Contractor being currently on site of Patch Project, it is <br /> anticipated and expected that the Patch Project will be completed in an efficient and timely manner; <br /> and, <br /> WHEREAS, City has determined that it is in the best interests of the City to waive any and <br /> all requirements it may have regarding bidding of public projects for the Patch Project and that it is <br /> within their rights as a home rule community to do so. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br />
