13)CONTINGENCY ALLOWANCE
a) A contingency allowance of$50,000 is being provided for additional, out of scope
services that may be required for work that has not been identified at this time.
ASSUMPTIONS, CLARIFICATIONS,AND EXCEPTIONS
The execution of this Scope of Work is based upon the following assumptions and clarifications:
1. The City will provide timely access to the project site, relevant facilities, and key personnel
as required for workshops and site visits.
2. The City will furnish all available existing documentation, including as-built drawings,
historical operational data, previous studies, and security assessment reports, in a digital
format.
3. The City is responsible for providing any necessary topographic survey data for the project
site. If a new survey is required, it can be added as a supplemental service.
4. The City will be responsible for the physical collection of the filter media core sample.
5. The City will perform up pH monitoring and flow monitoring for the lagoon blowdown to
establish a baseline for the pH adjustment system design during normal and modified pH and
loading rate testing.
6. BMcD is entitled to rely upon information or data received from or through the City without
independent verification.
7. Third-party laboratory analysis costs are not included in this scope of work.
8. The analysis of any field testing(e.g., the filter loading study)will be specific to the
operating conditions observed during the testing period. The findings are not a guarantee of
future performance under all conditions.
9. Site visits will be limited to non-intrusive, visual observations of accessible areas. This scope
does not include condition assessment, physical testing of equipment, destructive testing of
materials, or entry into confined spaces.
10. The evaluation of structural, architectural, and geotechnical conditions is limited to a visual
assessment of readily observable features.A detailed analysis of these systems is not included
in this scope.
11. The calculation for the new CT basin volume is based on an assumed baffling factor of 0.7.
The City acknowledges this is a standard assumption for a new, well-designed basin and that
a tracer study would be required during a later design phase to confirm the as-built baffling
factor.
12. All conceptual and preliminary designs will be based on readily available documentation and
the results of the workshops. The designs will not include detailed calculations for systems
outside the primary focus of this scope(e.g., detailed structural, HVAC, or plumbing
systems). These conceptual and preliminary designs are not for construction. After the City
reviews and approves the conceptual designs, they will be used solely and exclusively as the
basis for developing the OPCC for each individual project.
13. BMcD does not warrant or guarantee that any cybersecurity recommendations or suggestions
made will prevent future cybersecurity incidents.
14. The City will provide BMcD with information regarding the desired operational flexibility
for each of the chemical feed systems to be evaluated.
15.New GAC for filters will not be implemented until full scale pilot testing is performed at a
later date. Final empty bed contact time will also be confirmed at the end of the full scale
pilot testing.
11
