2. Tenant does hereby indemnify and hold h: less the District from any and all <br /> liabilities, costs and expenses, including attorney's f:es, incurred as a result either of a failure <br /> by Tenant to perform any covenant or understanding equired by this agreement or by any <br /> accident, injury, death or damage to any person or p operty which shall occur in the <br /> operation of the Premises. District hereby indemnifi-s and holds Tenant harmless from any <br /> and all liabilities, costs and expenses, including atto ey's fees, incurred as a result of a <br /> failure of District to perform any covenant or undert king required by this Agreement. <br /> G. TERMINATION <br /> At termination of this Agreement, either by e 'iration according to the terms of the <br /> Agreement,or for any other cause,Tenant agrees that any ••'fications or improvements to the <br /> Premises belong to District, except for Tenant's trade fixtures, which Tenant shall be free to <br /> remove at his expense. Any damage caused to the Pre ises by Tenant's removal of said trade <br /> fixtures shall be the sole responsibility of Tenant. Any debris, equipment, or other items deemed <br /> unsuitable for District use shall be removed from the p operty and the property returned to its <br /> original state minus any improvements now belonging o the District. Any rock,pavement, or <br /> other groundcover shall be removed to a depth of 12" : d replaced with topsoil and subsequently <br /> seeded back to a District approved grass mixture. If T- ant fails to return the Premises to the <br /> District as required herein within thirty (30) days of the termination of this Lease,the District <br /> shall be authorized to perform any necessary maintena ce and repairs to return the Premises to <br /> satisfactory condition at Tenant's sole cost and expens:. <br /> H. ASSIGNMENT <br /> With the written consent of the District, such co sent not to be unreasonably withheld, <br /> Tenant may assign his interest and obligations under t Agreement to a bona fide purchaser of <br /> the business, providing that the purchaser will use the p operty for the same use as currently <br /> exists, is financially responsible, meets commercially •sonable standards, and is ready, willing <br /> and able to carry out Tenant's obligations under the A: cment. <br /> I. DEFAULT <br /> 1. If any payment from Tenant becomes more han thirty(30) days past due, it shall <br /> be lawful for the District, upon twenty-one(21)days'written notice, to declare this <br /> agreement terminated and re-enter the Premises, eith. with or without process of law, to <br /> expel,remove and put out Tenant, or any person or • rsons occupying the Premises,using <br /> such force as may be necessary so to do, and the Dis' ict may repossess the Premises without <br /> prejudice to any remedies which might otherwise be sed. If the Premises shall be abandoned <br /> or vacated other than as provided by this Agreement, the District may re-enter the Premises <br /> and remove all articles, fixtures, equipment, or furni, ings found therein and place them in <br /> some suitable storage place at the sole cost and exile: se of Tenant. If said items are not <br /> claimed by Tenant within thirty(30) days, District m.y dispose of said items in any manner <br /> it sees fit. <br />
