2. If either party to this Agreement otherwise f• is to timely perform any material <br /> covenant or obligation required herein, and if that p. i fails to cure the default(act or <br /> omission to act as required by this agreement) within twenty-one(21)days after written notice <br /> of the default provided by the other party, this A. eement may thereafter be terminated <br /> upon fourteen (14) days' written notice. In the event f a material breach by Tenant,the <br /> District shall have the same additional rights and rem ies as provided in the event of a failure <br /> to make a payment as provided above. <br /> 3. District shall not be liable to Tenant for da ages or claims of any kind, including but <br /> not limited to business interruption losses, for Tenant's'nability to operate the mulch business <br /> on the Premises if such inability is caused by circums • •ces beyond District's control and <br /> without District's fault or negligence including, withou limitation: a)Acts of nature; b)Acts or <br /> failure to act on the part of any governmental authority ther than the District, including, but not <br /> limited to, enactment of laws, rules, regulations,codes ,r ordinances subsequent to the date of <br /> this Agreement;c)Acts of war; d)Acts of civil or miii : authority;e) Embargoes; f) Work <br /> stoppages, strikes, lockouts,or labor disputes; g) Publii'disorders, civil violence, or <br /> disobedience; h)Riots,blockades,sabotage, insurrectio , or rebellion;i)Epidemics or <br /> pandemics;j)Terrorist acts;k)Fires or explosions; 1) clear accidents; m)Earthquakes, floods, <br /> hurricanes,tornadoes, or other similar calamities;n) M:'or environmental disturbances; or o) <br /> Vandalism. If an inability to operate is caused by any o the force majeure circumstances set <br /> forth above, the District agrees to consider in good fait requests by Tenant for a temporary <br /> reduction or proration of Tenant's rent or any other of enant's financial obligations under this <br /> agreement. <br /> J, MISCELLANEOUS <br /> 1. Tenant agrees that the operation of the .usiness provided for in this agreement <br /> shall at all times be in full compliance with the Illino s Human Rights Act,the Illinois Human <br /> Rights Commission's rules and regulations, the Ill' ois Department of Labor's rules and <br /> regulations, and all provisions of any and all fed gal, state, and local equal employment <br /> opportunity statutes, ordinances, and provisions. <br /> 2. The operation of the business shall at al times be in compliance with all federal, <br /> state, city and District laws, ordinances, rules and re_4 lations. <br /> 3. The District may enter the Premises at casonable hours to confirm compliance <br /> with the terms of this Lease Agreement and do anyth ng which District may deem necessary <br /> for the good of the Premises. District shall provide T nant with reasonable notice in advance <br /> of any inspection of the Premises. <br /> 4. District shall not be liable for any i oss or damage to any merchandise, <br /> inventory, goods, fixtures, improvements or perso •1 property of Tenant in or about the <br /> Premises. <br /> 5. Tenant shall comply with all laws, orders, ordinances and other public <br /> requirements now or hereafter affecting the Premise or the use thereof, and Tenant shall <br />
