CITY OF DECATUR ILLINOIS
Of DEC
' y #1 GARY K. ANDERSON PLAZA DECATUR, ILLINOIS 62523-1196
' 4. Will MBEs be required to be licensed and bonded while working under the prime contractor?
Discussion: No, MBE subcontractors are covered under the General Contractor's insurance and
bonding and as such are not required to be licensed and bonded with the City other than what is
required under the contract. All subcontractors are under the responsibility and control of the General
Contractor.
' Newell reviewed Section 10-3. Minority Participation Goals in Public Projects. Discussion followed.
5. Jeff Burdick stated that the MBE percentage goals are approximately 2 times those required by the State
of Illinois and the pool of available subcontractors is limited by the City to just minority businesses that
exclude women and disabled businesses.
Discussion: Newell stated that IDOT set disadvantaged business goals on a project by project basis
' depending on DBEs in the project area. He reminded everyone that the contractor must make a good
faith effort to use MBEs as stated and described in paragraphs B-E of Section 3. If MBE
subcontracting opportunities do not exist, the General Contractors must only show their good faith
' efforts to meet the goal and proceed as necessary to hire non-MBE subcontractors.
6. The forms for"Minority Business Enterprise Participation Waiver Request" and " Subcontractor
' Utilization Statement"were distributed and discussed. Burdick Plumbing &Heating and Entler
Excavating Company Inc. stated that they rarely use subcontractors.
Discussion: Newell stated that subcontracting is not required but thorough documentation of the
' reasons for needing a waiver is very important for evaluating the bids especially if subcontractors are
used and an insufficient number of MBEs are used to meet the 10%goal.
' 7. Jeff Burdick questioned whether the list of minority contractors provided on ePrismSoft will be
upgraded routinely as more MBEs are added to the list. Presently the list only includes a barbering
enterprise and a food enterprise. As a result of an email request Burdick made to Rick Marley, Tara
' Bachstein supplied Mr. Burdick with the information found in the City's ePrism software program
which Jeff stated was difficult to navigate at the present time. Burdick stated that the list does not show
the capabilities of the MBEs.
Discussion: Newell stated that the list of minority contractors provided on ePrismSoft will continue to
grow as more MBEs register. Tara Bachstein (217-424-2747) and Gabe Jaja ((309-692-6400) will
tassist with any concerns regarding the software and getting each contractor familiar with it.
8. Entler described a problem he had with a minority subcontractor on another project regarding poor
' workmanship and not paying bills that the prime contractor had to resolve to complete the contract.
Discussion: Newell stated that the General Contractor can use documented past poor performance as
a reason not to hire certain MBEs. Documentation and reasoning to not use certain MBEs must be
included as part of the information provided to the City with the bid.
t
