AGREEMENT FOR CONSTRUCTION AND PAYMENT <br /> OF EXTERIOR RENOVATION OF BEACH HOUSE RESTAURANT <br /> The City of Decatur(City) and Decatur Park District(District) and Beach House I, <br /> Inc. (Mason) make this agreement to provide for the fagade and exterior renovations of the <br /> Beach House Restaurant operated and managed by Mason in#3 Pavilion in Nelson Park. <br /> A. RENOVATIONS <br /> The fagade and exterior renovations of the Beach House Restaurant shall be as <br /> substantially provided in the Bid Specifications under which the contract was awarded. <br /> B. COST AND PAYMENT <br /> 1. The parties estimate that the total construction cost will be Seven Hundred <br /> Sixty Thousand Five Hundred Dollars ($760,500) plus architectural and engineering fees. <br /> The parties will share this cost with Mason paying a total of$250,000. <br /> 2. The City's share, $250,000, shall be paid in three installments of <br /> $100,000, $100,000 and $50,000, with the first installment to be paid when the contract is <br /> signed, and the second and third installments annually on that date thereafter. The City's <br /> $250,000 contribution shall be specifically limited to sidewalk construction, work <br /> required for compliance with the Americans With Disabilities Act and the Lower Level <br /> Public Access Improvement. <br /> C. AWARD OF CONTRACT <br /> City, District and Mason will review the construction bids submitted and make <br /> the award. <br /> D. CONSTRUCTION <br /> District shall be in charge of the construction. City and Mason shall have the <br /> right to participate subordinate to the District. <br />
