- 2 - <br /> E. DISTRICT—MASON AGREEMENT TO CONTINUE <br /> District and Mason have an agreement whereby District has granted Mason a <br /> license to operate the Beach House Restaurant in#3 Pavilion and that agreement shall <br /> remain in full force and effect. Mason is entering into this agreement to discharge his <br /> repair and maintenance obligations under Section F of its Lease with the District. <br /> F. INSURANCE <br /> City, District and Mason will maintain extended coverage on the improvements <br /> constructed under this agreement and general liability insurance, with the amounts to be <br /> agreed upon by the parties. <br /> G. ASSIGNMENT <br /> City and District agree that they may not assign their interest or responsibilities <br /> under this agreement without the express written consent of the other. With the written <br /> consent of the District, such consent not to be unreasonably withheld, Mason may assign <br /> his interest and obligations under this agreement to a bona fide purchaser of the business, <br /> providing that the purchaser will use the property for the same use as currently exists, is <br /> financially responsible, meets commercially reasonable standards, and is ready, willing <br /> and able to carry out Mason's obligations under the agreement. <br /> H. COMPLIANCE <br /> Construction of the renovations as described herein shall be in compliance with <br /> the Building Codes of the City of Decatur, with federal and state law, and with City and <br /> District ordinances and regulations which pertain in any way to the design and <br /> construction of the improvements. <br /> I. MISCELLANEOUS <br /> 1. Modifications of this agreement shall be made in writing upon agreement <br /> of all the parties. <br />
