Illinois General Assembly fails to appropriate or otherwise make available sufficient funds <br /> for this Agreement. <br /> 15. INDEMNIFICATION: The Grantee covenants and agrees that it shall indemnify, <br /> protect, defend and hold harmless the Department,its directors,employees and agents,and <br /> the State of Illinois,from any and all liability, costs, damages,expenses,or claims thereof <br /> arising under,through or by virtue of performing under and complying with this <br /> Agreement. For purposes of this Agreement and this Paragraph,it is understood that the <br /> term"Grantee"includes Grantee's employees,officers, directors, agents and subgrantees. <br /> 16. RETURN OF FUNDS: All funds advanced to the Grantee that remain at the end of the <br /> grant agreement or at the expiration of the expenditure or obligation period stipulated in-the <br /> grant, shall be returned to the Department within 45 days as is required by the Illinois Grant <br /> Funds Recovery Act,30 ILCS 705/1. <br /> 17. RECORDS RETENTION AND AUDIT: The Grantee shall maintain,for a minimum of <br /> 3 years following project completion, satisfactory financial accounts,documents, and <br /> records associated with the project and the disbursement of grant funds pursuant to this <br /> Agreement,and shall make them available to the Department and the State of Illinois, <br /> Auditor General, or the Attorney General for auditing at reasonable times. Failure by.Mie <br /> Grantee to maintain such accounts,documents,and records as required herein shall <br /> establish a presumption in favor of the State of Illinois for recovery of any funds paid by <br /> the State per this Agreement for which adequate records are not available to support their <br /> purported disbursement. <br /> 18. THE FOLLOWING DOCUMENTS ARE INCORPORATED IN,AND MADE A <br /> PART OF THIS GRANT: <br /> Attachment A: MUD TO PARKS PROJECT <br /> ABSTRACT/DESCRUMON AND BUDGET <br /> SUMMARY <br /> Attachment B: SUBGRANTEE DISCLOSURE(IF APPLICABLE) <br /> Attachment C: GRANT CERTIFICATIONS <br /> Attachment D: GRANT COMPLIANCE REQUIREMENTS <br /> CERTIFICATION: (Must be completed by Grantee)Pursuant to the Illinois Grant Funds Recovery <br /> Act,30 ILCS 705/1,I or we certify under oath that all information in the grant agreement is true and <br /> correc to the best of my knowledge,information,and belief; and that the funds shall be used only for the <br /> pure s d e gr a ment;and that the award of the grant funds is conditioned upon such <br /> (Au t ) (Print Name) (Date) <br /> ®rantee initials <br />
