TERNIINATION: Either Party has the right to terminate this grant upon ten (10)days <br /> written notice to the other Party. This grant may be MY EDIATELY terminated by the <br /> Department under-any of the following conditions: <br /> a) Grantee fails to perform as required; <br /> b) Department determines Grantee's performance to be unsatisfactory; <br /> c) Impossibility to complete the project due to unforeseen circumstances. <br /> Payments may be made for work completed prior to termination that can be utilized lby.,the <br /> Department. All other legal and equitable remedies shall remain in effect including actions <br /> pursuant to the Illinois Grant Funds Recovery Act, 30 ILLS 705/1. Failure to enforce,a <br /> violation on one occasion shall not act as a waiver to enforce a violation on another <br /> occasion. <br /> 12. LAWS OF ILLINOIS: This grant shall be governed in all respects by the laws of the <br /> State of Illinois. Legal suits or claims of any kind shall be filed in Sangamon County. <br /> Grantee agrees that it shall be responsible for and obtain any and all necessary Permits, <br /> Licenses or Forms of Consent from any federal, state,local governmental entity,or private <br /> landowner. <br /> The work performed under this Agreement may be subject to the provisions of the Illinois <br /> Prevailing Wage Act, 820 ILCS 130/1 (IPWA). As such,if the Grantee determines the <br /> IPWA applicable,the Grantee must observe and comply with the provisions of this Act, <br /> regardless of the amount of grant funds expended on the project. For additional questions, <br /> the Grantee.should contact the Illinois Department of Labor at <br /> http://www.state.il.us/agency/idol/. <br /> 13. ADMINISTRATIVE CODE: It is hereby understood by'the Grantee that the rules and <br /> regulations heretofore and hereinafter promulgated by the Department relevant to the <br /> Conservation 2000 Ecosystems Program as set forth at 17 Ill.Adm. Code 1523 shall be <br /> considered a material part of this Agreement to which the Grantee must comply. <br /> 14. .SUBJECT TO APPROPRIATION: Obligations of the State of Illinois will cease <br /> immediately without penalty of further payment being required if in any fiscal year the <br /> rantee initials <br />
