GENERAL CONDITIONS <br /> GC-10 INDEMNIFICATION <br /> The Contractor agrees to indemnify and hold harmless the City of Decatur, and its <br /> officers and its employees, from and against all liability, claims, demands and expenses, <br /> including court costs and attorney fees, on account of any injury, loss or damagd which arise out <br /> of or are in any manner connected with the work to be performed under this Agreement, if such <br /> injury, loss or damage is caused in whole or in part by, or is claimed to be caused in whole or in <br /> part by the negligent acts, errors or omissions of the Contractor, any Subcontractor of the <br /> Contractor, or any officer employee or agent of the Contractor. The obligations of this Section <br /> shall not apply to damages which the City of Decatur shall become liable by final judgment to <br /> pay to a third party as the result of the negligent act, error or omission of the City of Decatur, its <br /> officers, employees or agent of the City of Decatur. <br /> GC-11 INSPECTION <br /> The Contractor shall give sufficient advance notice of placing orders to permit tests to be <br /> completed before the materials are incorporated in the work and he shall afford such facilities as <br /> the Engineer may require for collecting and forwarding samples and making inspections. All <br /> costs connected with the furnishing and testing of samples will be borne by the Contractor. <br /> Independent testing laboratories may be used provided they meet the approval of the City. <br /> GC-12 LANE CLOSURE PERMITS <br /> It is the Contractor's responsibility to obtain all necessary lane closure permits. Any costs <br /> incurred in obtaining these permits are to be incidental to the related contract item. Permit fees <br /> will be waived for those permits issued by the City of Decatur. <br /> 23 <br />
