ANDERSON PLAZA DECATUR, ILLINOIS 62523-1196 <br /> */ILI NOBS <br /> June 2, 2014 <br /> Rick Dunning, Senior Vice President <br /> First Transit, Inc. <br /> 600 Vine Street, Suite 1400 <br /> Cincinnati, Ohio 45202 <br /> RE: Post-Award Protest <br /> Request for Proposals—Transit Management <br /> Dear Mr. Dunning, <br /> On May 27, 2014, the City of Decatur received your Post-Award Protest letter, dated May 23, <br /> 2014, concerning the Decatur City Council's decision to award a transit management contract to <br /> MV Transportation, Inc. In your letter you state two complaints: <br /> • MV Transportation's proposal was "conditional" and therefore non-responsive with <br /> the Request for Proposals (RFP); and <br /> • The scoring of the proposals by the Evaluation Committee was not conducted in a fair <br /> and objective manner. <br /> Concerning your first complaint, you state that the General Manager candidate proposed by MV <br /> Transportation for Decatur was also proposed, at the same time, to another transit system, and <br /> that MV Transportation did not disclose this fact to Decatur. The Decatur City Council <br /> discussed this matter at its meeting on May 19t" and found that MV Transportation's proposal <br /> was not a conditional proposal. <br /> Concerning your second complaint, while you may disagree with the scoring of the two firms by <br /> the Evaluation Committee, please note that the Committee merely made a recommendation to <br /> Council. The City Council members were informed before the May 19t" meeting of the seven <br /> criteria that were used by the Evaluation Committee, as specified in the RFP, to score the two <br /> proposals, and the City Council did consider these criteria in a fair and objective manner before <br /> making its decision. <br /> Therefore, the Decatur City Council finds that the argume is and ssertions contained in your <br /> Post-Award Protest letter are without merit. l i <br /> Tvcer ly f <br /> �/ <br /> cE <br /> Mayor <br /> cc.
