SUMMARY Staff recommends that Council adopt a Resolution authorizing the RECOMMENDATION: Mayor to send a letter to First Transit, Inc., denying their protest of the Council's decision to award the transit management contract to MV Transportation, Inc. BACKGROUND: On May 19, 2014, the Decatur City Council voted to award a contract to MV Transportation, Inc., to manage the Transit System. On May 27th the City received a letter from First Transit, Inc., protesting the award. The letter claims 1)that MV Transportation's proposal was "conditional" because the firm proposed the same person as General Manager to Decatur and to another transit system; and 2)that the scoring of the proposals was not conducted in a fair and objective manner. Staff has studied these allegations and has drafted the attached letter in response to the protest. The letter concludes that the arguments and assertions contained in the Post- Award Protest letter are without merit. POTENTIAL First Transit, Inc. may submit a protest to the Federal Transit OBJECTION: Administration(FTA). A protest to the FTA would be limited to the City's failure to follow its protest procedures, or its failure to respond in writing no later than seven working days after the May 27 receipt of the protest.
