Zientara, Interim City Manager <br /> SUBJECT: Ordinance Approving City Code Addition in Chapter 28, Unlawful Discrimination, <br /> Addressing the Matter of Minority Participation Goals for Public Works Contracts <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached ordinance which shall create an <br /> addition to City Code Chapter 28, Unlawful Discrimination. <br /> BACKGROUND: <br /> This ordinance will establish City Policy to encourage a diverse workforce for all public projects, <br /> whereby the City will establish goals for participation by Minority Business Enterprises ("MBE") <br /> and minority workers for public works contracts. <br /> The ordinance sets out the objectives of the minority participation goals to include: <br /> • Ensuring non-discrimination in the award and administration of City public works <br /> contracts; <br /> • Encourages a level playing field on which MBE and minority workers can compete fairly <br /> for public works contracts; <br /> • Helping to remove barriers to the participation of MBE and minority workers in City public <br /> works contracts; <br /> • Promotes the use of MBE and minority workers in City public works projects; <br /> • Ensuring minority participation goals are narrowly tailored in accordance with applicable <br /> law; <br /> • Providing appropriate flexibility to contractors in establishing and providing opportunities <br /> for MBE and minority workers <br /> The ordinance further establishes definitions of "Minorities" and "Minority Business Enterprise, <br /> MBE) in accordance with and as defined in the Illinois Business Enterprise folr Minorities, Female <br /> and Persons with Disabilities Act, 30 ILCS 575/2. <br /> The ordinance further defines minority participation goals in public projects, including, <br /> • Ten (10) percent of the total dollar amount of the contract should be performed by MBE if <br /> subcontracting opportunities are available, and <br /> • Eighteen (18) percent of the total hours worked should be performed by minority workers <br />
