January Excerpts from Plan Commission Minutes of Ja ry 8,2015 continued:
Staff recommends approval of the B-3 amendment with the following conditions:
a. The five (5) parallel parking spaces adjacent to the ATM stacking spaces shall be removed
from the plan. Plans were received yesterday reflecting the removal of these five(5)spaces.
b. The dwarf variety of the burning bush may be used as long as the height or spread at time of
installation is 24 inches.
c. Existing grading shall be provided on sheet C1.2 prior to the petition being heard by City
Council. Plans were received yesterday that provided sheet C1.2.
According to Section XIII.F. of the Zoning Ordinance the Plan Commission shall review the
application at a public hearing and will make findings concerning the consistency of the
application with the Comprehensive Plan, the Zoning Ordinance and other land development
regulations. Based on the findings, the Plan Commission will make a recommendation to the
City Council. A motion to forward Calendar Number 15-02 to the City Council with a
recommendation for approval is suggested.
Mr. Kent Newton asked if staff would have recommended approval of this item with the current
configuration if it had been originally submitted this way in June. Ms. Stickle said yes.
Mr.Rick Heavner, representative, was sworn in by Mrs. Poland.
Mr. Heavner stated this was not intentional. It was simply a result of a survey error. Mr.
Heavner said as Ms. Stickle stated, if the plan had been submitted this way in the first place it
would have been recommended by staff. At this point in time, since it is built with the
underground gas tanks already installed, it would be prohibitively expensive to move it. Mr.
Heavner said they are basically saying they are sorry for the mistake and would like the Plan
Commission to recommend the amendment to the City Council for approval.
Mr.Newton asked how the error was discovered. Mr.Heavner said the contractor discovered it.
Mr. Matt Dial asked if the amendment was acceptable to Brettwood Village. Mr. Heavner said
they were fine with the amendment.
There were no objectors present.
It was moved and seconded(Dial/Smith)to forward Calendar No. 15-02 to the City Council with
a recommendation for approval. Motion carried unanimously.
