Excerpts from Plan Commission Minutes of January 8,2015:
i
Cal.No. 15-02 Petition of THE KROGER CO.,AN OHIO
CORPORATION,to amend the B-3 Planned
Shopping Center District located at 3070 NORTH
I
WATER STREET.
Ms. Stickle presented the recommendation of staff:
The subject site is an approximately 18.5 acre commercial development. It is currently zoned B-
f 3 Planned Shopping Center District. This shopping center was approved for rezoning to a B-3
k Planned Shopping Center District by City Council in July of 1961.
Subsequent amendments to the B-3 have been approved by Council, including the
reconfiguration of the parking areas and a ministorage facility that was never constructed. Most
recently in June of 2014, the B-3 was amended to allow for the construction of a fuel center with
a kiosk and the relocation of the Automated Teller Machine(ATM).
The subject petition requests that the B-3 be amended to allow for the reduced setback of the fuel
canopy and parking lot. The fuel center has seven (7) dispenser islands and is located in the
western portion of the development along North Water Street.
The Automated Teller Machine (ATM) has been relocated and is now located east of the
dispenser islands.
The fuel canopy and parking lot were both constructed farther west than they were originally
approved by the June 2014 B-3 Amendment. The fuel canopy has been constructed 18.4 feet
west of what was approved in June 2014. The approved front yard setback was 60.7 feet and the
front yard setback as constructed is 42.3 feet. The parking lot was moved 5.5 feet west of the
approved location. The approved front yard setback for the parking lot was 9.0 feet, the parking
lot setback was constructed with a 3.5 foot front yard setback.
The total number of parking spaces as approved by the B-3 amendment in June of 2014 was 832.
With the location of the fuel center as it was actually constructed, there will be a reduction of 15
parking spaces. The spaces approved to be located along the west side of the fuel center area
will no longer be provided. Kroger's current plan adds five (5) parallel parking spaces adjacent
to the ATM stacking spaces. The proposed parallel spaces and approved stacking spaces are
only separated by a 2.5 foot painted median. Staff believes these may be more detrimental than
beneficial to the overall operation of the site and recommend these five (5) spaces be removed
from the plan. The total number of parking spaces for the entire subject site will now be 817.
The proposed amendment to the B-3 is consistent with the character of the surrounding
neighborhood and general area. The shopping center has been located in the area since the 1960s
and does not appear to have had an adverse effect on the neighborhood or general area.
The B-3 is consistent with the intent of the approved B-3, its amendments and the
Comprehensive Plan.
The B-3 plan has been reviewed and approved by the City's Technical Review Committee,
Planning, Engineering and Fire.
