The building material of the fagade will consist mainly of stucco which is consistent with the
intent of the original B-2 PUD.
There are private ingress/egress easements located on the lots that will be vacated prior to site
plan approval.
City water and sewers are available to adequately serve the proposed developry ent.
Staff believes that the proposed development is compatible with the surrounding area and will
have a positive impact on the area in general. The plan is consistent with the intent of the
originally approved B-2 PUD.
The B-2 PUD plan has been reviewed by the City's Technical Review Committee; Planning,
Engineering and Fire have approved the proposed plan.
Based on the analysis, the proposed Planned Unit Development amendment is onsistent with the
intent of the original B-2 PUD. Staff recommends approval of the petition ith the following
condition:
1. Signage shall be in accordance with the originally approved B-2 PUD.
2. Prior to site plan approval, recorded documentation that the pri-vate ingress/egress
easements have been vacated shall be submitted.
3. Final site, landscaping and lighting plans shall be submitted to and approved by the
Planning and Building Services Department, the Department of Engineering and
Infrastructure and the Fire Department prior to building permits being roleased.
Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold
a public hearing to review the Planned Unit Development plan and report its findings concerning
the effect on the comprehensive plan and compliance with the standards of review to the City
Council. A motion to forward Calendar Number 14-07 to the City Council with a
recommendation for approval is suggested.
Mr. Phil Cochran, representative for the petitioner, was sworn in by Mrs. Althc ff.
Mr. Cochran stated that the property when it was first zoned was zoned as a B-2, PUD. Mr.
Cochran stated that traditionally the Plan Commission does not see site plans and subdivisions;
usually it is the site planning process. Mr. Cochran stated that however thro gh the developers
agreement and throughout the process it was decided that the City wanted to iave a greater role
in the development of the sites and one way to do that that was to make I hem PUD's. Mr.
Cochran stated that each time a lot is developed at Cardwell Crossing, they w 11 come before the
Plan Commission to request a change in the PUD because presently it is vac a t ground and Plan
Commission will get a chance to see the development. Mr. Cochran stated as staff indicated in
2002, the B-2 PUD was approved in 2004 and the subdivision was approv d to 15 lots. Mr.
Cochran stated that since approval of the subdivision there have been two developments, the
Victorian Woods Senior Living Facility at the south end and the Bank of Nia tic.
