Excerpts from Plan Commission Minutes of October 3,2013:
Cal. No. 13-51 Petition of BINK INC. and THE WO DMOUND INC.,
to amend the B-3 Planned Shopping Center District
located at 3775 NORTH WOODFORD STREET.
Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland.
Mrs. Stewart presented the recommendation of staff:
The subject property contains the Woodmound Plaza Shopping Center and approx mately 4.2 acres.
The original B-3 Planned Shopping Center District was approved by the City Council in June 1978 and
has had amendments since that time.
On June 3, 2013 the City Council voted 6-1 to approve the B-3 Planned Shopping Center District. The
petitioner proposed to construct an enclosed outdoor patio (34' x 15.0'); a 16' x 1 ' building expansion
for a vestibule; a 13' x 6' building expansion where the drive thru would be relocated; and a storage
building (20' x 18'). Their request also included a reduction in spaces from ten (10) to five (5)
stacking spaces for a drive thru window. Ten stacking spaces are required for a restaurant.
The petitioner proposes to amend the approved B-3 Planned Shopping Center District in order to
expand the existing building along the east side. The building expansion would be a total of 837.5
square feet (33.5' x 25') addition.
The owners are requesting the addition in order to expand their business and provide additional
customer area and stage for a band.
The B-3 Planned Shopping Center District amendment is consistent with the intent of the originally
approved B-3 Planned Shopping Center District.
The addition to the building does not change or alter the essential character of the approved B-3.
The B-3 Planned Shopping Center District amendment has been reviewed and approved by the City's
Technical Review Committee, Planning, Engineering and Fire.
Staff recommends approval of the B-3 Planned Shopping Center District amendment with the
following condition:
a. Final site, landscaping and lighting plans shall be submitted to and approved by the
Planning and Building Services Department, the Department of Public Works and the
Fire Department prior to building permits being released.
Section XIII.F.2. of the City of Decatur Zoning Ordinance requires the Plan C )mmission to hold a
public hearing to review the B-3 Planned Shopping Center District plan an report its findings
concerning the effect on the comprehensive plan and compliance with the stand rds of review to the
City Council. A motion to forward Calendar Number 13-51 to the City Council with a
recommendation for approval is suggested.
Ms. Sharon Samuelson, representative, was sworn in by Mrs. Poland.
Ms. Samuelson stated the petitioners would like to expand the east end of their b ilding. The request
is being made at this time as they have expanded their food menu and have identified a need for
additional seating inside. They will also use this area to occasionally host a band.
Mr. Matt Dial asked if everything the petitioners want to do is tied into to the a isting building. Ms.
Samuelson said yes.
There were no objectors present.
It was moved and seconded (Dial/Myatt) to forward Calendar No. 13-51 to the City Council with
recommendation for approval. Motion carried unanimously.
