No. 13-39 Petition of MARK ALLEN, to amend the B-3 Planned
Shopping Center District located al. 105 WEST FIRST
DRIVE.
Ms. Stickle presented the recommendation of staff:
The subject site is zoned B-3 Planned Shopping Center District and has been zoned as such since
1963. The property contains approximately 20,900 square feet. The petitioner is currently building
a structure. Since 1963 there have been many amendments to the original B-3 plan, with the most
recent amendments being this year.
On April 1, 2013 an amendment was approved by City Council that allowed f the construction of
a 3,406 square foot commercial/office development to be located on one (1) lot not to be less than
20,900 square feet in area.
The Zoning Board of Appeals (ZBA) approved a variance on April 11, 2013 to allow for the
reduction of lot sizes in the B-3 District for a proposed four (4) lot minor final I ilat of subdivision to
be called Lindy Lu South Addition.
The last amendment to the B-3 Planned Shopping Center District was approvec. by City Council on
June 3, 2013 and allowed for the development on two (2) lots with 3,200 quare feet of space
situated in two (2) zero lot line buildings that will share a common wall. Together the buildings
will have 2,267 square feet of office space and 933 square feet of space for a ba /cocktail lounge.
The subject petition requests that the B-3 be amended to allow for the addition of 1,159 square feet
of restaurant use in place of office space that was approved in previous amendments. This proposed
use will increase the required number of parking spaces.
The previous amendment approved on April 1, 2013 required 23 spaces to be provided which was 4
more spaces than required by the Zoning Ordinance. The Zoning Ordinance requires a total of 26
spaces for the development with this proposed change in use from office to restaurant. The
amendment has provided 27 parking spaces.
The development currently proposed by the petitioner is a commercial/office development. The
proposed 3,200 square feet of space will be situated in two (2) zero lot line buildings that will share
a common wall. Together the buildings will have 1,159 square feet of restaurant space, 1,108
square feet of office space and 933 square feet of space for a bar/cocktail lounge.
The proposed amendment to the B-3 is consistent with the character of the surrounding
neighborhood and general area. Properties to the north, east and west are also B-3 developments
and have been developed commercially.
The B-3 is consistent with the intent of the previously approved B-3 amendment and the
Comprehensive Plan.
The B-3 plan has been reviewed and approved by the City's Technical Review ommittee,
Planning, Engineering and Fire.
Staff recommends approval of the B-3 amendment with the following condition:
a. Final site, landscaping and lighting plans shall be submitted to and approved by the
Department of Planning and Building Services, Public Works Department and the Fire
Department prior to building permits being released.
