Excerpts from Plan Commission Minutes of May 2, 2013:
Cal. No. 13-15 Petition of BINK, INC. and THE WOODMOUND,
INC., to amend the B-3 Planned Shopping Center
District located at 3775 NORTH WOODFORD
STREET.
Mrs. Stewart presented the recommendation of staff:
The subject property contains the Woodmound Plaza Shopping Center and approximately 4.2
acres.
The original B-3 Planned Shopping Center District was approved by the Ci[y Council in June
1978 and has had amendments since that time.
The petitioner proposes to amend the approved B-3 Planned Shopping Center District in order to
construct an enclosed outdoor patio (34' x 15.0'); a 16' x 10' building expansion for a vestibule;
a 13' x 6' building expansion where the drive thru will be relocated; and a storage building (20'
x 18').
The drive thru window will have a total of five (5) stacking spaces. Ten (10) stacking spaces are
required for a restaurant. The drive thru is for pick up only and therefore, nc menu/order board
will be allowed to be utilized with the drive thru.
The B-3 Planned Shopping Center District amendment is consistent with the intent of the
originally approved B-3 Planned Shopping Center District.
The additions to the building, the addition of the patio and storage build ng as well as the
relocation of the drive thru do not change or alter the essential character of the approved B-3.
The B-3 Planned Shopping Center District amendment has been reviewed and approved by the
City's Technical Review Committee, Planning, Engineering and Fire.
Staff recommends approval of the B-3 Planned Shopping Center District aniendment with the
following conditions:
a. No menu/order board will be allowed for the use requesting five (5 stacking spaces.
b. An exit shall be maintained through the fenced patio to a public way.
c. Final site, landscaping and lighting plans shall be submitted to and approved by the
Department of Planning and Building Services, the Department of Public Works and
the Fire Department prior to building permits being released.
Section XIII.F.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold
a public hearing to review the B-3 Planned Shopping Center District plan anreport its findings
concerning the effect on the comprehensive plan and compliance with the standards of review to
the City Council. A motion to forward Calendar Number 13-15 to the City Council with a
recommendation for approval is suggested.
Ms. Adrienne Lynch, representative, was sworn in by Mrs. Poland.
Ms. Lynch stated the petitioner would like to construct an enclosed outdoor patio which happens
to be in the location of the existing drive thru window. The drive thru window needs to be
relocated.
