B4: 4350 Page: 703 <br /> ORDINANCE NO. 2013-47 <br /> ORDINANCE AUTHORIZING EXCEPTIONS TO THE ZONING ORDINANCE <br /> -NO FRONTAGE ON A PUBLIC STREET- <br /> - NO DIRECT ACCESS TO PUBLIC STREET- <br /> - 1100 BLOCK OF EAST PERSHING ROAD— <br /> i <br /> WHEREAS, on the 7th day of February, 2013, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the request of TR of Decatur, LLC, requesting <br /> exceptions to the Zoning Ordinance to allow no frontage or direct access to a p iblic street for the <br /> proposed Lot (3) in the proposed subdivision located in the 1100 BLOCK OF AST PERSHING <br /> ROAD in the M-1 Intense Commercial/Light Industrial District. The is parcel legally described <br /> as follows: <br /> Lot Two (2) of WSOY Centre, as per Plat recorded in Book 5000 Page 32 of the <br /> Records in the Recorder's Office of Macon County, Illinois; <br /> and, <br /> WHEREAS, the purpose of this action is to subdivide parcels wheteby, upon <br /> subdivision, Lot One (1) and Lot Two (2) of the proposed Girl Scout Addiion as per <br /> Exhibit A shall have frontage on and direct access to a public street and Whereby Lot <br /> Three (3) shall be allowed to not have frontage on or direct access to a public street until <br /> such time as it is to be developed. As a condition for allowing this exception to the <br /> Zoning Ordinance for Lot Three (3), it shall be required that a private access road be <br /> constructed to said lot; <br /> and, <br /> WHEREAS, the Decatur City Plan Commission recommended th�t said request be <br /> granted. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That upon the conditions set forth below, the above described Premises be, <br /> and the same are hereby, allowed to be subdivided so that the proposed Lot Three (3) as is <br /> defined in Exhibit A be allowed to have no frontage on or direct access to a public street: <br /> A. A private access road maintenance statement shall be required on t e Final <br /> Plat that reads as follows: "A private access road shall be maintain d by <br /> the owner(s)to ensure continuous access for emergency vehicles a� <br /> approved by the City of Decatur's Public Works and Fire Departm$nts." <br /> i <br />
