105 West First Drive
May 2, 2013
PROJECT DESCRIPTION
1. The subject petition requests that the B-3 be amended to allow for the redevelopment of the
property to be located on two (2) lots.
2. The petitioner requested the variance from the ZBA for reduced lot sides to allow for the
operation of a bar/cocktail lounge which is required by the Zoning Ordi*ce to be located
100 feet from any side lot line of any property in a residential district. When the variance
was granted it created an issue with lot sizes that are required to be maintained in a B-3
district for development. The lot size requirement for development inl the B-3 District is
20,000 square feet.
i
3. The petitioner is proposing a commercial/office development. The pro
osed 3,200 square
feet of space situated in two (2) zero lot line buildings that will sh e a common wall.
Together the buildings will have 2,267 square feet of office space and 933 square feet of
space for a bar/cocktail lounge.
4. The request for amendment is being made so that a bar/cocktail lounge c4 be located in the
northernmost building of the proposed development.
STAFF ANALYSIS
1. The proposed amendment to the B-3 is consistent with the character of th surrounding
neighborhood and general area. Properties to the north, east and west are Iso B-3
developments and have been developed commercially.
2. The B-3 is not consistent with the intent of the original B-3 and the Comp ehensive Plan nor
is it consistent with the recent amendment to the B-3. The proposed deve opment is not
consistent as it is being proposed to be developed on two (2) lots that are ignificantly
smaller than is required by the regulations of the B-3 District. Proposed Lot Two (2) will be
only 37%of the required lot area and Lot(3)will be 63% of the required lot area. The
amendment approved by Council on April 1, 2013, specifically requires that the lot area shall
not be less than 20,900 square feet. i
3. The request for amendment is being made so that a bar/cocktail lounge cai be located in the
northernmost building and meet the requirement that it must be located 1 0 feet from a side
lot line of a property located in a residential district. The property can be developed in a
reasonable manner without having to reduce the lot area that is required b the B-3 District
and required by the recently approved amendment.
4. The B-3 plan has been reviewed by the City's Technical Review Commitee, Planning,
Engineering and Fire.
STAFF RECOMMENDATION
I
1. Staff recommends denial of the B-3 amendment.
i
