Excerpts from the Plan Commission Minutes of May 2, 2013:
Cal. No. 13-16 Petition of MARK ALLEN,to amend the B-3 Planned
Shopping Center District located at 105 WEST FIRST
DRIVE.
Ms. Stickle presented the recommendation of staff:
The subject site is currently vacant commercial land approximately 20,900 square feet in area and is
zoned B-3 Planned Shopping Center District and has been zoned as such since 1963.
In 2009, an amendment was approved allowing for the construction of a structure where the
Subway and Dale's Southlake Pharmacy are currently located.
There was another amendment approved by the City Council in 2010 to allow for the construction
of the Walgreens and the reconfiguration of the structure that currently houses IMonical's Pizza and
the Hickory Point Bank.
The last amendment to the B-3 was approved by City Council on April 1, 2013 that allowed for the
construction of a 3,406 square foot commercial/office development to be located on one (1) lot not
to be less than 20,900 square feet in area.
The Zoning Board of Appeals (ZBA) approved a variance on April 11, 20113 to allow for the
reduction of lot sizes in the B-3 District for a proposed four (4) lot minor final plat of subdivision to
be called Lindy Lu South Addition. The variance reduced proposed Lot Two (2) of Lindy Lu South
Addition from the required 20,000 square feet to 7,681.03 square feet and proposed Lot Three (3)
from 20,000 square feet to 13,278.69 square feet.
The subject petition requests that the B-3 be amended to allow for the redevelopment of the
property to be located on two (2) lots.
The petitioner requested the variance from the ZBA for reduced lot sizes to allow for the operation
of a bar/cocktail lounge which is required by the Zoning Ordinance to be locat$d 100 feet from any
side lot line of any property in a residential district. When the variance was granted it created an
issue with lot sizes that are required to be maintained in a B-3 District for development. The lot
size requirement for development in the B-3 District is 20,000 square feet.
The petitioner is proposing a commercial/office development. The proposed ,3,200 square feet of
space situated in two (2) zero lot line buildings that will share a common ',wall. Together the
buildings will have 2,267 square feet of office space and 933 square feet of sp$ce for a bar/cocktail
lounge.
The request for amendment is being made so that a bar/cocktail lounge can be located in the
northernmost building of the proposed development.
The proposed amendment to the B-3 is consistent with the character of the surrounding
neighborhood and general area. Properties to the north, east and west are also B-3 developments
and have been developed commercially.
The B-3 is not consistent with the intent of the original B-3 and the Comprehen$ive Plan nor is it
consistent with the recent amendment to the B-3. The proposed development iso not consistent as it
is being proposed to be developed on two (2) lots that are significantly smaller 1han is required by
the regulations of the B-3 District. Proposed Lot Two (2) will be only 37% of the required lot area
