Excerpts from the Plan Commission Minutes of May 2,2013 continued:
and Lot (3) will be 63% of the required lot area. The amendment approved by Council on April 1,
2013, specifically requires that the lot area shall not be less than 20,900 square fet.
The request for amendment is being made so that a bar/cocktail lounge can be located in the
northernmost building and meet the requirement that it must be located 100 feet'ifrom a side lot line
of a property located in a residential district. The property can be developed in 4 reasonable manner
without having to reduce the lot area that is required by the B-3 District and required by the recently
approved amendment.
The B-3 plan has been reviewed by the City's Technical Review Committee, P14nning, Engineering
and Fire.
Staff recommends denial of the B-3 amendment.
According to Section XIII.F. of the Zoning Ordinance the Plan Commissi6n shall review the
application at a public hearing and will make findings concerning the consistency of the application
with the Comprehensive Plan, the Zoning Ordinance and other land development regulations.
Based on the findings, the Plan Commission will make a recommendation to the City Council. A
motion to forward Calendar Number 13-16 to the City Council with a recommendation for denial is
suggested.
Chairman Livingston asked what had changed since the approval last month. Ms. Stickle said it
was sent through the first time without the bar/cocktail lounge and on one I(1) lot. They had
requested from the Zoning Board of Appeals to have the actual plat allow forlthereduction in lot
sizes.
Mr. Phil Cochran, representative, said this plan is basically the same one pre$ented at the March
Plan Commission meeting. It went to City Council on April 1, 2013 and was passed unanimously.
Mr. Cochran said most of the time when you have a B-3 Planned Shopping' Center District the
developer is not aware of all the uses allowed. The Ordinance allows the bar/cocktail lounge,
however; the issue is the 900 square feet where it is going to be located. This pert of the building is
within 100 feet of the residential district. The solution to the issue was to createl two (2) lots.
Mr. Cochran said the total lot size is 20,900 square feet. They went to the Zoning Board of Appeals
asking for a variance for two (2) lots. Lot one (1), to the north, would be 7,600 square feet. Lot two
(2), the south lot, would be the remainder. This was unanimously approved by the Zoning Board.
Mr. Cochran stated if you are driving down the street you will not know that aipything has changed
from the approved plan in March. The only difference is that the developer will be able to use the
space to the north as he chooses as a lounge. The lot line will be a common w4ll. There are many
buildings like this downtown. It is one building, one site.
Mr. Cochran said staff is concerned about the size of the lots. The developer would have to come
back to the Plan Commission with any changes he was planning to make. B-3'is site plan specific
and has to meet all the other requirements of the Zoning Ordinance. This will of be developed as
two (2) parcels. This is economic development and Mr. Allen is going to s end approximately
$700,000.
Mr. Newton asked why the approach was to make two (2) lots instead of aski g for a variance on
the one lot for this use. Mr. Cochran said at the time the developer did not havO any firm plans and
it was decided to get the plan approved first. Mr. Cochran said they were not coknfortable going to
