I
Excerpts from the Plan Commission Minutes of May 2,2013 continued:
the Zoning Board of Appeals requesting two (2) small lots if the conceptplan had not been
approved.
Mr. Mark Allen, petitioner, was sworn in by Mrs. Poland.
Mr. Allen said he has improved the South Shores area in the last twelve (12) fifteen (15) years.
They have spent a lot of money installing the wall as a nice barrier between thbusinesses and the
residential area. He would appreciate the Plan Commission's support.
Chairman Livingston asked if this project was part of Mr. Allen's initial plan. IIr. Allen said he did
not remember. They have been toying around with various ideas for this property for some time
now. This development will be similar to Dale's Southlake Pharmacy.
Mr. Dale Colee, Dales' Southlake Pharmacy, was sworn in by Mrs. Poland.
Mr. Colee said once Mr. Allen is finished with this project it will look very nice. This development
is going to be a very positive thing for South Shores.
Mr. John asked for the rationale for staff's recommendation. Ms. Stickle stated the rationale for
denial is that by reducing the lot sizes, you are creating a potential problem in the future. If
something goes wrong and the development does not occur or something goes wrong a few years
from now, and these lots are sold to two (2) different individuals, they could come back and say the
City approved these two (2) small lots and now we cannot meet the Ordnance requirements
because we cannot use the property in a reasonable manner. As planners, this is what we are
supposed to be looking at; what are the possibilities and the ramifications of the$e decisions.
Mr. Billy Tyus was sworn in by Mrs. Poland.
Mr. Tyus stated what could possibly occur, if approved, is that you have created a situation where
you have two (2) lots that may not be buildable at all. As Planners, staff looks at what occurs now
and what could possibly occur in the future. This is a significant reduction in the size of the lots,
not a small reduction.
Mr. Cochran said we cannot be afraid of what is going to happen thirty years from now. This is
economic development.
It was moved and seconded (Myatt/Smith) to forward Calendar No. 13-16 to the City Council with
recommendation for approval as submitted by the petitioner. Motion carried 6-2 with Mr. Steve
John and Mr. Glenn Livingston voting no.
