i
i
Excerpts from Plan Commission Minutes of January 3,2013:
Cal.No. 13-04 Petition of NIEMAN FOODS, INC.,to rezone
property located in the 1100 BLOQKS of WEST
GRAND and WEST LEAFLAND AVENUES and the
1200 BLOCK of NORTH OAKLAND AVENUE
from R-3 Single Family Residence District and B-1
Neighborhood Shopping District to B-2 Commercial
District.
Ms. Stickle presented the recommendation of staff:
The subject site is approximately three (3) acres and is located in the 110 Blocks of West
Leafland and West Grand Avenues and the 1200 Block of North Oakland Avenue. The southern
portion of the site is developed with single family homes and the northern position was the site of
a former dry cleaner and grocery store.
The petitioner proposes to rezone from R-3 Single Family Residence j District and B-1
Neighborhood Shopping District to B-2 Commercial District to allow for th10 construction of a
supermarket. A supermarket according to the Zoning Ordinance is a retail itore that is greater
than 30,000 square feet and is primarily engaged in the sale of edible products and it is only
permitted in the B-2 Commercial or the M-1 Intense Commercial/Light Indus ial Districts.
The surrounding zoning includes B-2 Commercial District to the north and west and R-3 Single
Family Residence District to the south and east. The Macon County and Decatur
Comprehensive Plan shows this area as Retail and Residential-Low Density. The proposed use
is compatible with adjacent uses to the north and west.
Staff recommends approval of the rezoning.
A motion to forward Calendar Number 13-04 to the City Council with a recommendation for
approval is suggested.
Mr. Matt Dial asked if the homes that are included in the proposed rezoning } ere still occupied.
Ms. Stickle said yes.
Ms. Shan Clevenger, representative, was sworn in by Mrs. Poland.
Ms. Clevenger said Niemann Foods believes this area could be well served with a County
Market supermarket. Niemann Foods has signed agreements with all of the homeowners to
acquire their properties. Once the rezoning is approved and the properties are purchased they
will develop the grocery store.
There were no questions and no objectors present.
It was moved and seconded (Frantz/Newton) to forward Calendar No. 13-04 to the City Council
with recommendation for approval as submitted. Motion carried unanimously.
There being no further business, it was moved and seconded (Dial/Frantz) to adjourn the
meeting. Motion carried unanimously. Meeting adjourned at 3:25 P.M.
i
I
i
