Stickle, Senior Planner <br /> SUBJECT: Zoning Ordinance exception allowing no frontage or direct access t a public street, <br /> reduced lot area and lot width for a plat in the 1500 to 1700 Blocks of South Franklin Street Road <br /> SUMMARY RECOMMENDATION: Staff recommends approval of an oidinance authorizing <br /> exceptions to the Zoning Ordinance allowing no direct access to a public street, no!frontage on a public <br /> street and a reduced lot area and lot width. The City Plan Commission voted �-0-1 to recommend <br /> approval of this petition at the January 3, 2013 meeting;the minutes of the meeting a�e attached. <br /> BACKGROUND: The Final Minor Plat of Fisherman's Wharf Addition was reviewed by Engineering, <br /> Fire and Planning and is approved pending approval this ordinance. The owner proposes to subdivide the <br /> property into five (5) lots, none of which will have frontage or direct access to a pub is street. According <br /> to the Zoning Ordinance each lot shall have frontage on, or direct access to, a publi4 street or way that is <br /> improved to City standards, unless the Council shall otherwise direct, by approval ofa subdivision plat so <br /> showing submitted, heard and considered in the manner provided in the subdivision Regulations for the <br /> City. The lot area and lot width of Lot Four (4) are smaller than what is req#fired by the Zoning <br /> Ordinance. <br /> The purpose of the subdivision is to create five (5) small lots which are adjacent to rive (5) existing lots. <br /> These proposed lots are being created so that the adjacent landowners to the southan purchase the new <br /> lots and add to their existing rear yards. This property is located between apartmetts and single-family <br /> homes and Lake Decatur and is owned by the Park District; it is considered excess property to the Park <br /> District and is not an integral part of the Park system. Some of the adjacent property'owners have utilized <br /> the land as part of their rear yards and/or access to the lake for years. <br /> Roughly 50 percent or more of each of the proposed lots are located in the 100-ye4r floodplain. If the <br /> owners of the adjacent properties want to build accessory structures in the future,theroperty will have to <br /> be re-platted/subdivided. Staff does not foresee issues with allowing these lots to created with no <br /> frontage and no direct access to a public street or reduced lot area and lot width for Lot Four(4). <br /> POTENTIAL OBJECTION: There were no known objectors at the Plan CommissJon Meeting. <br /> INPUT FROM OTHER SOURCES: The petition has been reviewed by the Cityhs Technical Review <br /> Committee; Planning, Engineering and Fire have approved the plat. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan M.
