01)N3-0 3 <br /> CHAPTER 29 <br /> ADMINISTRATIVE ADJUDICATION OF OFFENSBS <br /> (Adopted, Ordinance No. 2011-64) <br /> 1. Definitions. Whenever used herein, the following words shall have the meaning set <br /> after them as follows: <br /> A. ACES -means Administrative Code Enforcement System. <br /> B. City Official - means all full-time police officers,as well as any other <br /> officer, agent or employee of the City of Decatur authorized to enforce the City Code. <br /> C. Complaint — means a formal written accusation against a person or entity such as a <br /> ticket or notice of violation for a violation of the City Code. <br /> D. Default—means a failure to appear for a scheduled hearing or legal proceeding. <br /> E. Emergency Situations -means those situations that reasonably constitute threats to the <br /> public interests, safety or welfare, <br /> F. Hearing Officer — means a municipal employee or an officer or agent of a <br /> municipality appointed pursuant to this Chapter, other than a law enforcement officer whose duty <br /> it is to: <br /> (1) Preside at an administrative hearing called to determine Whether or not a code <br /> violation exists; <br /> (2) Issue subpoenas directing witnesses to appear and give relevant testimony at <br /> administrative hearings, upon the request of the parties or their representatives; <br /> (3) Administer oaths, hear testimony and accept evidence from all interested <br /> parties relevant to the existence of a code violation; <br /> Revised 1/13 <br />
