"Construction Monitor" means any individual or entity engaged by the City, at the <br /> City's own cost and expense, to (i)review and recommend to the City with respect to the <br /> renovation of the Police Facility by the Redeveloper, (ii) inspect the renovation of the <br /> Police Facility and (iii) monitor any other matters with regard to this Agreement and/or <br /> the Police Facility as directed by the City. <br /> "Construction Plans" mean construction documents which are complete for <br /> construction of the Police Facility or any separate and distinct functional phase or part <br /> thereof and which will allow for the issuance of all permits for the construction of the <br /> Police Facility or any phase or part thereof required by all governmental agencies having <br /> jurisdiction over the construction of the Police Facility. <br /> "Cost of the Police Facility" means the costs and expenses related to the development <br /> of the Police Facility in order to make it available for occupancy including but not limited <br /> to architectural and engineering design services and related consulting specialties, <br /> physical construction activities, interior design and decorating purchase of FF&E., <br /> interest expense related to a construction loan, development fees and other ancillary and <br /> related expenses. <br /> "Criteria Document " means plans and drawings and written specifications prepared by <br /> the City which are preliminary to the Construction Plans and which set forth the design <br /> development of the exterior and interior of the Police Facility and which include but are <br /> not limited to the limits of the work to be done, the interior layout including rooms, <br /> finishes and system descriptions the location of the building and all auxiliary structures, <br /> ingress and egress, loading areas, proposed signage, landscaping and one or more <br /> elevations showing the Exterior Architectural Appearance of the Police Facility. <br /> "Design Standards" means those requirements approved by the City which govern the <br /> design of the Police facility including the use of materials in its construction. <br /> "Effective Date" means that which is set forth in the Preamble of this Agreement. <br /> "Environmental Laws" means all statutes specifically described in the definition of <br /> Hazardous Materials and all federal, state and local environmental, health and safety <br /> statutes,ordinances,codes,rules,regulations,orders and decrees regulating,relating to or <br /> imposing liability or standards concerning or in connection with Hazardous Materials. <br /> "Exterior Architectural Appearance" means the architectural character, general <br /> composition and general arrangements of the exterior of the Project and the adjacent <br /> plazas and pedestrian areas, including the kind, color and texture of the building material <br /> and the type and character of all windows, doors, light fixtures, signs and appurtenant <br /> elements,visible from public streets and thoroughfares. <br /> "FF&E" means those items of furnishings, fixtures and equipment for use in the <br /> operation of the Police facility. <br /> "Final Police Facility Cost Analysis" means the statement of actual costs and expenses <br /> of the construction and development of the Police Facility including the Costs of the <br /> Police Facility submitted by the Redeveloper to the City in certified form after <br /> completion of the Police Facility. <br /> 3 <br />
