challenging officer shall be afforded the opportunity to meet with the Professional Standards <br /> Lieutenant to remedy the challenge. If the officer is still not satisfied with the results, the officer <br /> shall within ten days of that decision provide a written challenge to the question or questions to <br /> the three person arbitration panel. The panel shall consist of the Chief of Police or designee, <br /> Union President or designee and a third party to be determined by agreement between the City <br /> and Union. The decision of the panel shall be final. <br /> All challenges to questions utilized in the testing process shall be determined on the basis <br /> of the operational policy or procedure utilized in the Department at the time the test was given. <br /> ARTICLE 8 <br /> REDUCTION IN PERSONNEL <br /> Section 1. When the number of persons authorized to a position classification in the <br /> classified police service is reduced, the employee with the least seniority in such position <br /> classification shall be the first to be reduced in rank or removed from the service if no reduction <br /> in rank is possible. When the number of persons authorized to the classified police service is <br /> reduced, the employee with the least seniority in the classified police service shall be the first to <br /> be removed from the service. <br /> A person reduced in rank shall receive the salary of the reduced rank. A person removed <br /> from service shall be considered furloughed without pay. If any position vacated, displaced or <br /> abolished because of reduction of force is filled or reinstated, the person last reduced in rank or <br /> furloughed from such position as the case may be if otherwise qualified shall be the first person <br /> restored or reinstated in such position. When such positions are to be filled or reinstated, notice <br /> to the eligible persons shall be given by registered mail at the address filed by said person with <br /> the Department. Written application for reinstatement must be made by the person seeking <br /> restoration to rank or reinstatement within fifteen (15) days from the date such notice was mailed <br /> to said address. A person seeking reinstatement from furlough may be required to submit to <br /> examination by physicians of the Civil Service Commission and the police pension board, or <br /> either of them, to determine the physical fitness of such person. <br /> ARTICLE 9 <br /> DISCIPLINE AND DISCHARGE <br /> Section 1. Upon just cause connected with or reflecting upon the public service, an <br /> employee may be administratively disciplined by an oral reprimand, a written reprimand or <br /> suspension. An employee shall be entitled to comment upon any oral reprimand that is placed on <br /> record in the shift commander's file in the space provided for same on the card containing such <br /> reprimand, and such reprimand and any comments thereon shall also be forwarded immediately <br /> to the Chief if so requested by the employee or a commanding officer as noted on said card. <br /> 14 <br />
