FIRST AMENDMENT DATED 2/19/2013 TO: <br /> INTERGOVERNMENTAL COOPERATION AGREEMENT <br /> DATED NOVEMBER 24, 1980 BETWEEN CITY OF DECATUR,ILLINOIS, <br /> AND DECATUR CIVIC CENTER AUTHORITY <br /> FOR SPACE TO BE OCCUPIED BY CITY WITHIN CIVIC CENTER COMPLEX <br /> THIS FIRST AMENDMENT IS TO THE AGREEMENT between the CITY OF <br /> DECATUR, a municipal corporation organized under the laws of the State of Illinois ("CITY") , <br /> and the DECATUR METROPOLITAN EXPOSITION,AUDITORIUM AND OFFICE <br /> BUILDING AUTHORITY, a unit of local government organized under the laws of the State of <br /> Illinois ("AUTHORITY"). <br /> WHEREAS,the CITY and AUTHORITY entered into an AGREEMENT <br /> ("AGREEMENT") dated November 24, 1980 for the purpose of describing the use and <br /> occupancy by the CITY of that portion of the Civic Center facilities (sometimes referred to <br /> herein as"Complex") as described in said AGREEMENT designated as an office building to be <br /> used by the CITY as a municipal office building,including the use and occupancy of the parking <br /> lot area; and, <br /> WHEREAS,the parties to the AGREEMENT desire to further define in this FIRST <br /> AMENDMENT to the AGREEMENT the parking lot area for use by the CITY. <br /> NOW,THEREFORE, in consideration of the premises and the mutual obligations of the <br /> parties hereto,each party does hereby covenant and agree with the other,for their mutual benefit <br /> as follows: <br /> ARTICLE ONE OF FIRST AMENDMENT TO AGREEMENT <br /> The parties hereto do hereby revoke and eliminate Exhibit E. Parking Lot Regulations as <br /> stated in Paragraph 1.1 (p.3) contained in Article I of the AGREEMENT entitled"Enumeration <br /> of Exhibits" and substitute therefor a revised copy of said"Exhibit E. Parking Lot Regulations" <br /> attached hereto and made a part hereof. <br /> ARTICLE TWO OF FIRST AMENDMENT TO AGREEMENT <br /> The parties hereto revoke and eliminate Paragraph 4.2.(b)(p.7) entitled"Division of Costs <br /> -Parking Lot" contained in ARTICLE IV of the AGREEMENT entitled"Custodial Services" <br /> and substitute the following: <br /> (b) Parking lot. The CITY's share of the cost of janitorial services for the parking lot <br /> shall be that portion which the number of parking spaces set aside for exclusive <br /> use by the CITY bears to the total number of parking spaces available in the <br /> parking lot.
