spaces of either the CITY or the parking lot change, the CITY's portion of such <br /> costs shall be re-computed to reflect such change. As of the date of this First <br /> Amendment to the AGREEMENT,the portion.referred to in this paragraph 4.2(b) <br /> is 281/453rds or 62.03%. <br /> ARTICLE THREE OF FIRST AMENDMENT TO AGREEMENT <br /> 1. The parties hereto do hereby revoke and eliminate Paragraph 9.1(a)(p.14A) <br /> entitled"Regulation of Parking Lot" as contained in ARTICLE IV entitled"Parking" and <br /> substitute therefor the following: <br /> 9.1. Regulation of parking lot. <br /> (a) The AUTHORITY may from time to time impose reasonable regulations <br /> pertaining to the use of the parking lot located in the Civic Center Complex. Such <br /> regulations may include,but are not limited to, the designation of days and hours <br /> the parking lot shall be open and a designation of specific areas in which vehicles <br /> owned by the CITY, and its officers, employees and members of the CITY <br /> Council, commissions and boards as well as CITY designees and invitees must be <br /> parked ("CITY Parking Area" or "CITY Parking Spaces."). The Regulations are <br /> more specifically defined in Exhibit E attached hereto and made a part hereof. <br /> (a)-1 Definitions. "CITY users" as that term is used in this AGREEMENT shall <br /> mean vehicles owned or used by the CITY or its officers,employees,members of <br /> the CITY Council, commissions and boards. "CITY invitees" shall refer to those <br /> vehicles owned or used by persons doing business with the CITY in the Civic <br /> Center Complex. "CITY designees" shall mean those vehicles that are owned or <br /> used by persons who the CITY is permitting to use certain designated space for <br /> parking on the parking lot of the Civic Center. <br /> (a)-2 CITY Designee Parking Spaces. The CITY may designate parking spaces for <br /> no more than a contiguous 157 parking spaces for use by CITY designees. Such <br /> spaces for CITY designees are shown on the parking lot plat of the CIVIC <br /> CENTER COMPLEX attached to Exhibit E. <br /> (a)-3 At such time in the future as the CITY determines CITY designee parking space is <br /> no longer needed in the parking lot,then such space as is allocated therefor will <br /> revert to public usage as determined by the AUTHORITY. <br /> 2. The parties hereto do hereby revoke and eliminate Paragraph 9.2 (p.14A) entitled <br /> "Parking Charges" as contained in ARTICLE IV and substitute therefor the <br /> following: <br /> -3- <br />
