9.2. Parking charges. <br /> In accordance with the regulations of the AUTHORITY pertaining to parking, a <br /> CITY user or CITY designee shall not be charged by the AUTHORITY for parking <br /> his,her or its vehicle in the parking lot. However,the AUTHORITY reserves the <br /> right to impose parking charges,whether determined by gates,meters or otherwise, <br /> upon the use of the parking lot by any other persons,including invitees of the CITY. <br /> 3. The parties hereto do hereby revoke and eliminate Paragraph 9.5 (p.15) entitled <br /> "Change of Location or Temporary Reduction of Parking" as contained in ARTICLE IV and <br /> substitute therefore the following: <br /> 9.5. Change of location or temporary reduction of parking_ <br /> Notwithstanding anything to the contrary stated herein,the AUTHORITY reserves <br /> the right to (a)change the location,from time to time of, or(b) temporarily eliminate <br /> all CITY Parking Spaces in the parking lot,provided however, the AUTHORITY <br /> may temporarily eliminate all CITY parking spaces only under the following <br /> conditions: (1) such elimination may take place for three days only during May <br /> through October,inclusive, during the days of Monday through Friday, (2)the <br /> CITY shall be given thirty(30) days prior written notice of the dates of such <br /> elimination of parking and (3) CITY owned vehicles may be parked on the parking <br /> lot in a location specified by the AUTHORITY. <br /> ARTICLE FOUR OF FIRST AMENDMENT TO AGREEMENT <br /> If the CITY desires the Authority to maintain an attendant in a booth at the main entrance <br /> to the parking lot from the hours of 12:00 Noon to 6:00 pm on each work day during which the <br /> parking lot is used by CITY users or City designees,then the City agrees, on a monthly basis, to <br /> reimburse the AUTHORI'T'Y for the cost and expense incurred by the AUTHORITY. <br /> ARTICLE FIVE OF FIRST AMENDMENT TO AGREEMENT <br /> 1. All other terms and conditions contained in the AGREEMENT dated November <br /> 24, 1980 shall remain the same, are hereby confirmed and shall remain in full force and effect. <br /> 2. This FIRST AMENDMENT to the AGREEMENT dated November 24, 1980 <br /> shall not change,modify,impair,limit or supersede any other Intergovernmental Cooperation <br /> Agreements presently in existence between the AUTHORITY and the CITY. <br /> -4- <br />
