r o►3- I C5 <br /> RIGHT OF ENTRY LICENSE <br /> THIS RIGHT OF ENTRY LICENSE, hereinafter called "License", Made and entered into this12?lnd <br /> day of , 2013, by and between CITY OF DECATUR, hereinafter referred to as <br /> "Licensor', and AMEREN ILLINOIS COMPANY d/b/a AMEREN ILLINOIS, an Illinois corporation, <br /> hereinafter referred to as"Licensee", <br /> WITNESSETH: <br /> That Licensor, for and in consideration of the covenants of Licensee hereinafter set out, by these <br /> presents does permit Licensee, its employees, contractors and agents the right of occupancy and <br /> vehicular ingress and egress upon and over Licensor's Property site, hereinafter called "Property", being <br /> located adjacent to an Ameren substation, located at 515 E. Main St., Decatur, II 62523, and as <br /> referenced in Exhibit"A". <br /> TO HAVE AND TO HOLD THE Property, subject to the conditions herein contained and <br /> terminating as provided in Section 2 hereof. <br /> 1. USE. Entry will be for the purpose of performing site investigation activities, hereinafter <br /> referred to as "Project", on the Property located at 136 S. Franklin St., Decatur, Illinois, 62523, and as <br /> referenced in Exhibit"A". Authorized activities may include, but are not limited to, the following items: <br /> a) conducting a boundary survey and topographic survey of the Properties and placing <br /> permanent or temporary survey markers on the Properties; <br /> b) the staging of temporary fencing and barricades around the investigation Project area in <br /> order to control unauthorized access; <br /> c) the placement of temporary barricades and signage for control of traffic and protection of <br /> construction personnel; <br /> d) the installation of permanent, pre-stressed metal tie-back soil anchors that will protrude <br /> at an angle through sheet piling. Soil anchors will penetrate into Licensor's property <br /> below ground surface. The sheet pile will be installed on the Ameren site (adjacent to <br /> Licensor's Property) in order to maintain stabilization of Licensor's property as <br /> referenced on Exhibit"B". <br /> Upon completion of such activities, the Licensee shall remove any temporary barricades, <br /> signage, and temporary fencing. The soil anchors penetrating under the property shall not be removed. <br />
