Intergovernmental Cooperation Agreement South Shores Bridge Replacement Project INTERGOVERNMENTAL COOPERATION AGREEMENT Between the Sanitary District of Decatur,a Municipal Corporation, and the City of Decatur,Illinois,a Municipal Corporation,both of Macon County,Illinois for the replacement of the South Shores Bridge and relocation of the Sanitary District sewer This AGREEMENT made this day of , 2012,is between the Sanitary District of Decatur,Illinois,an Illinois unit of local gover ent,Macon County, Illinois ('DISTRICT")and the City of Decatur,Illinois,a Municipal Corporation,Macon County,Illinois ("CITY"). WHEREAS,pursuant to Article VII, section 10 of the 1970 Constitution of the State of Illinois, and the Illinois Intergovernmental Cooperation Act(5ILCS 220/1 et seq- 1992),units of local government in the State of Illinois may contract between themselves to obtain or share services and to exercise or combine functions which either of the units of local government are authorized by law to perform;and, WHEREAS,the CITY agrees that the replacement of the South Shores Bridge over Sand Creek is the responsibility of the CITY, WHEREAS,the DISTRICT agrees that the relocation of the Sanitary District interceptor attached to the existing bridge is the responsibility of the DISTRICT, WHEREAS,the CITY and DISTRICT agree that the South Shores Bridge over Sand Creek needs to be replaced to adequately serve the public and that the DISTRICT interceptor needs to be relocated as part of the project, WHEREAS,the DISTRICT requests that the CITY manage the interceptor relocation as part of the bridge construction project. NOW,THEREFORE,in consideration of the mutual covenant herein contained,the parties agree as follows: 1. AGREEMENT FOR CONSTRUCTION The DISTRICT acknowledges and agrees that the CITY will enter into an agreement with the State of Illinois acting by and through its Department of Transportation(STATE)for the construction of the South Shores Bridge over Sand Creek,which construction will include the relocation of the DISTRICT's interceptor. The improvement shall be constructed in accordance with plans approved by the DISTRICT,the STATE and the STATE's policies and procedures approved and/or required by the Federal Highway Administration. The DISTRICT acknowledges and agrees that the STATE will advertise and receive bids for the construction of the improvement and will award a contract for construction of the proposed improvement after receipt of a satisfactory bid. The construction contract will be between the successful contractor and the STATE. The STATE will administer the contract. The draft Local Agency Agreement is attached as Exhibit A. AGREE - 1
