MACON COUNTY BOARD RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF DECATUR AND THE COUNTY OF MACON COVERING PUBLIC TRANSPORTATION RESOLUTION NO. H-1792-1-12 WHEREAS, THE COUNTY OF MACON, ILLINOIS ("County"), a body politic and corporate in the State of Illinois, and THE CITY OF DECATUR, ILLINOIS ("City"), a municipal corporation, support the access to and availability of public transportation in the County of Macon; and WHEREAS,the 1970 Illinois Constitution, Art. VII, Section 10 and 5 Illinois Compiled Statutes 220/3 provide authority for intergovernmental cooperation; and WHEREAS,the City and the County understand the necessity for governmental cooperation to promote access to and availability of public transportation; and WHEREAS, the City has the Federal authority to provide public transportation to the Decatur urbanized area as defined by the most recent United States Census ("Census"); and WHEREAS, the County has the Federal authority to provide public transportation to the remaining rural area in Macon County outside of the Decatur urbanized area as defined by the most recent Census; and WHEREAS, the City's Decatur Public Transit System does not provide public transportation in all of the areas within the Decatur urbanized area, resulting in several unserved "Gray Areas"; and WHEREAS, the County cannot serve these "Gray Areas" with their Rural Transit System without the cooperation and assistance of the City; and WHEREAS, the County and the City desire to make provisions for public transportation services in the "Gray Areas" and for the allocation of funds between the City and the County to finance those services. NOW, THEREFORE, in consideration of the mutual agreements contained herein, it is agreed between the County and the City as follows: 1. Incomoration of Recitals. The Preamble Recitals of this Intergovernmental Agreement are hereby adopted and incorporated as if fully set forth herein. 2. Representations and Compliance with the Intergovernmental Cooperation Act. The County and the City hereby represent on their behalf as follows: A. Each is a public agency as defined in 5 ILCS 220/2.
