MACON COUNTY BOARD RESOLUTION APPROVING AN <br /> INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF DECATUR AND <br /> THE COUNTY OF MACON COVERING PUBLIC TRANSPORTATION <br /> RESOLUTION NO. H-1792-1-12 <br /> WHEREAS, THE COUNTY OF MACON, ILLINOIS ("County"), a body politic and corporate <br /> in the State of Illinois, and THE CITY OF DECATUR, ILLINOIS ("City"), a municipal <br /> corporation, support the access to and availability of public transportation in the County of <br /> Macon; and <br /> WHEREAS,the 1970 Illinois Constitution, Art. VII, Section 10 and 5 Illinois Compiled Statutes <br /> 220/3 provide authority for intergovernmental cooperation; and <br /> WHEREAS,the City and the County understand the necessity for governmental cooperation to <br /> promote access to and availability of public transportation; and <br /> WHEREAS, the City has the Federal authority to provide public transportation to the Decatur <br /> urbanized area as defined by the most recent United States Census ("Census"); and <br /> WHEREAS, the County has the Federal authority to provide public transportation to the <br /> remaining rural area in Macon County outside of the Decatur urbanized area as defined by the <br /> most recent Census; and <br /> WHEREAS, the City's Decatur Public Transit System does not provide public transportation in <br /> all of the areas within the Decatur urbanized area, resulting in several unserved "Gray Areas"; <br /> and <br /> WHEREAS, the County cannot serve these "Gray Areas" with their Rural Transit System <br /> without the cooperation and assistance of the City; and <br /> WHEREAS, the County and the City desire to make provisions for public transportation <br /> services in the "Gray Areas" and for the allocation of funds between the City and the County to <br /> finance those services. <br /> NOW, THEREFORE, in consideration of the mutual agreements contained herein, it is agreed <br /> between the County and the City as follows: <br /> 1. Incomoration of Recitals. The Preamble Recitals of this Intergovernmental <br /> Agreement are hereby adopted and incorporated as if fully set forth herein. <br /> 2. Representations and Compliance with the Intergovernmental Cooperation Act. The <br /> County and the City hereby represent on their behalf as follows: <br /> A. Each is a public agency as defined in 5 ILCS 220/2. <br /> FILED B. The scope of this Agreement relates to the performance of governmental <br /> services, activities or undertakings, which the agency entering into this <br /> JAN 13 2012 Agreement are authorized by law to perform. <br /> - 1 - <br /> Stephen K4.
