Excerpts from Plan Commission Minutes of July 5,2012 continued:
reaching the first formation which is at approximately 5,500 feet. They will be checking ground water as part of
their permit protocol and also have numerous other technical monitoring tools that are used to check the
integrity and impact of the formation.
Mr. Matt Beck said he lives within 200 feet of this project. Mr. Beck asked if City staff looked into what effect
this project will have on his property value and asked if City staff should have to talk to residents concerning
this. Mr. Beck said he is proud of his home. The trade of property between the Park District and ADM, along
with the rezoning of this property will have a severe effect on the value of his property and the quality of life for
him, his family and neighbors. Mr. Beck stated he is all about Decatur and ADM but he wants to be treated
fairly. He does not want this in his backyard.
Ms. Suzy Stickle stated City staff posts signs and publishes a legal notice in the paper fifteen (15) days prior to
the meeting. Staff does not go to the residences directly; they follow State statute and the Zoning Ordinance
requirements.
Mr. Heavner stated that ADM is aware of the residents that are in the area. Mr. Fred Kenny, who is an in-house
ADM attorney, has talked to Mr. Beck and will continue to talk to him and the residents in the area to address
their issues.
Ms. Amy Bliefnick asked if there are any plans to close Faries Park Road that leads to Rea's Bridge Road. Mr.
McDonald said he does not know of any restrictions in the current access.
Mr. Matt Beck asked if there was an economic consideration in regard to the residences concerning the rezoning
of the property. Ms. Stickle stated staff does not have a formula available to evaluate property value.
Mr. Chad Davis stated he does not understand why the entire area is being rezoned. He said everyone is worried
about the future expansion once this property is rezoned. Mr. McDonald stated he is aware of some expansions,
however; they do not take up a considerable footprint. They are developing a project that would convert
biomass into chemicals and fuels which would require more room. Mr. McDonald said if there is future
expansion the property to the north of the north substation, the area to the east of the facility and the gun club
area are the most probable areas the expansion would occur.
Mr. Brad Pugh stated the M-2 zoning boundary would come approximately fifteen(15) feet from the front of his
house. Adding the fifty (50) foot setback required by the City, that is 65 feet. Mr. Pugh stated when the Park
District sold property to ADM there were no plans for expansion and today there is power station needed. Mr.
Pugh would like to know what tomorrow will bring and what the protection for the residents is.
Mr. Pugh has a copy of a letter received from ADM outlining certain commitments to the area residents. ADM
has not lived up to the commitments. (A copy of this letter is attached.) He is concerned how neighbors and
emergency vehicles will access the property if the road is closed.
It was moved and seconded (Livingston/Myatt) to table Cal. No. 12-20. Motion failed 3-2-3, with Steve John
and Kent Newton voting no, and Bill Clevenger, Jim Grady and Susie Peck abstaining from the vote. Four (4)
affirmative votes are required for the motion to be carried.
Mr. Heavner stated ADM is on a tight time frame as they would like to start this project later this summer,
however; they do not want anyone to think that ADM is railroading through a project that is not in the best
interest of the residents.
It was moved and seconded (Newton/Frantz)to reconsider the vote to table Cal. No. 12-20. Motion carried 5-0-
3, with Bill Clevenger,Jim Grady and Susie Peck abstaining from the vote
Upon reconsideration, Cal. No. 12-20 was tabled with a vote of 5-0-3 with Bill Clevenger, Jim Grady and Susie
Peck abstaining from the vote.
