City Plan Commission
August 2,2012
Page 5
Mr. Chad Davis was sworn in by Mrs. Poland.
Mr. Davis said that the woods filter out the smell of ADM. He is concerned with the health issues
this development could possibly create. He believes that in the future ADM will develop Faries
Park as much as the existing facility and that is what the residents will have to look at.
Mr. Darrell Woolums was sworn in by Mrs. Poland.
Mr. Woolums stated he is an attorney representing Mary Query who owns ninety-two acres at the
north end of Tract A. He said she is not in opposition of the project they just want to make sure the
City will not do anything to shut off access to her property.
Mr. Heavner stated ADM has no plans to change the roadways, however; roadways have nothing to
do with the rezoning. There are absolutely no plans to change the access as it is now. Mr. Heavner
understands the residents' concerns and so does ADM. That is the reason they changed the entire
rezoning to two (2) smaller Tracts. If they ever decide to develop the property further, ADM will
have to come back to the Plan Commission.
Mr. Heavner does not believe the residents' argument for the guarantee of the value of their homes
is a good argument because ADM has taken out 1,250 feet for the rezoning project. If ADM would
come back another day to ask to rezone close to their homes then they would have an argument.
You cannot see anything past four hundred feet. Nothing can be done other then what is allowed in
the R-1 District unless ADM comes back to the Plan Commission. ADM is not a bad neighbor. If
at some point in the future, which there are not plans now, ADM decides to rezone the R-1 District
they would discuss a buyout or reach some type of agreement. The project injects CO2 in the
ground 7,000 feet, this project will not affect anyone's well. Water wells are normally only eighty
to 110 feet. This will be a good project for Decatur.
It was moved and seconded (Newton/Frantz) to forward Cal. No. 12-20 to the City Council with
recommendation for approval as presented by staff. Bill Clevenger and Jim Grady abstained. Three
members voted "aye". Matt Dial and Jack Myatt voted "nay". On the advice of Assistant
Corporation Counsel the Chairman declared the motion passed.
There being no further business, it was moved and seconded (Myatt/Dial) to adjourn the meeting.
Motion carried unanimously. Meeting adjourned at 4:30 P.M.
Kent Newton, Secretary
Decatur City Plan Commission
