Excerpts from Plan Commission Minutes of June 7, 2012: Cal. No. 12-16 Petition of JAMIE HENRY for a Conditional Use Permit to operate a Day Care Home, Large at 1976 EAST DECATUR STREET in the R-3 Single Family Residence District. Mrs. Joselyn Stewart was sworn in by Mrs. Poland. Mrs. Stewart presented the recommendation of staff: The subject site is developed as a single family residence and located at 1976 East Decatur Street. The subject petition requests a conditional use permit to allow the operation of a licensed large home daycare facility. The daycare would accommodate a maximum of eight (8) children. A large home daycare facility located in the R-3 District requires a Conditional Use Permit. The petitioner's drop off and pick up area will be in front of her house along East Decatur Street. There is adequate room for the children to play in the rear yard which is entirely fenced. Section XXII.A.3. lists three standards which must be met in order to grant a conditional use permit. The first standard requires the applicant to show that the use is "necessary for the public convenience at the location." The proposed use is generally compatible with the neighborhood and provides a service which can be utilized by area residents. The proposed use also meets the second standard. The facility is located and designed to be operated in a manner that the public health, safety and welfare will be protected. This use also meets the third standard. The facility will not cause substantial injury to the value of other properties in the neighborhood. The daycare use will be required to meet all applicable City building and fire codes, as well as all requirements imposed by the State in the issuance of a home day care license. Based on the analysis, staff recommends approval of the conditional use permit as submitted with the following conditions: a. That the proposed operation be limited to a maximum of eight (8) children, b. That the proposed operation be in compliance with applicable provisions of the City's adopted Building Codes, including obtaining a building permit to perform any proposed or required improvements to the existing dwelling, c. That the proposed daycare be at all times appropriately licensed by the State of Illinois and a copy of that license, upon approval, will need to be filed with the Planning and Building Services Division and, d. The State Fire Marshall shall be contacted regarding a field inspection and a copy of the fire inspection report, upon completion, will need to be filed with the Fire Department. Section XXII.A.2. requires the Plan Commission to hold a public hearing on a conditional use permit request, and then forward its report and recommendation to the City Council for final approval. A motion to forward Calendar Number 12-16 to the City Council with a recommendation for approval is suggested.
