DEVELOPMENT SERVICES MEMORANDUM No. 12-29 June 13, 2012 TO: Honorable Mayor Michael T. McElroy and City Council FROM: Ryan P. McCrady, City Manager Billy Tyus, Assistant City Manager Suzan M. Stewart, Transportation Planner SUBJECT: Issuance of a Conditional Use Permit to be allowed to operate a licensed large home daycare facility at 1976 East Decatur Street SUMMARY RECOMMENDATION: Staff recommends approval of the CUP (Conditional Use Permit) with the following conditions: a.) That the proposed operation be limited to a maximum of eight(8) children, b.) That the proposed operation be in compliance with applicable provisions of the City's adopted Building Codes, including obtaining a building permit to perform any proposed or required improvements to the existing dwelling, c.) That the proposed daycare be at all times appropriately licensed by the State of Illinois and a copy of that license, upon approval, will need to be filed with the Planning and Building Services Division and, d.) The State Fire Marshall shall be contacted regarding a field inspection and a copy of the fire inspection report, upon completion, will need to be filed with the Fire Department. The City Plan Commission voted 8-0 to recommend approval of this petition at the June 7, 2012 meeting; the minutes of the meeting are attached. BACKGROUND: The subject site is developed as a single family residence and located at 1976 East Decatur Street. The subject petition requests a conditional use permit to allow the operation of a licensed large home daycare facility. The daycare would accommodate a maximum of eight (8) children. A large home daycare facility located in the R-3 District requires a Conditional Use Permit. The petitioner's drop off and pick up area will be in front of her house along East Decatur Street. There is adequate room for the children to play in the rear yard which is entirely fenced. POTENTIAL OBJECTION: There were no known objectors at the Plan Commission Meeting. INPUT FROM OTHER SOURCES: The CUP has been reviewed by the City's Technical Review Committee; Planning, Engineering and Fire have approved the CUP.
