Excerpts from Plan Commission Minutes of June 7, 2012:
Cal. No. 12-17 Petition of NIEMANN HOLDINGS, LLC, to
amend the B-3 Planned Shopping Center District
located in the 2200 BLOCK OF EAST WILLIAM
STREET to allow for a drive-up window and to
reduce the number of parking stalls in the B-3
District.
Mrs. Stewart presented the recommendation of staff.
On November 5, 2009 the City Plan Commission voted 7-0 to approve the rezoning from B-1
Neighborhood Shopping District to B-3 Planned Shopping Center District. The petition was
approved by City Council by a 7-0 vote on November 16, 2009.
The subject site is located in the 2200 Block of East William Street and is currently developed as
a Retail Strip Shopping Center with a parking lot on approximately 4.23 acres.
The petitioner proposes to amend the B-3 Planned Shopping Center District in order to allow for
a reduction in the approved building square footage from 42,945 square foot to 42,195 square
foot, to reduce the number of parking spaces from 235 to 215 a reduction of twenty (20) spaces
and to allow for a drive-up window on the west side of the building.
The proposed drive-up window would be allowed five (5) stacking spaces instead of the required
ten (10) stacking spaces for a restaurant and the drive-up window previously shown on the future
stand-alone building would be eliminated.
Staff believes that the proposed development is compatible with the surrounding area and has
had a positive impact on the neighborhood. The plan amendment is consistent with the
comprehensive plan for commercial development.
Even with the reduction of parking spaces and stacking spaces for the drive-up window, parking
is still sufficient to meet the needs of the center. Loading and unloading docks are also adequate
to serve the site.
The B-3 Planned Shopping Center amendment plan has been reviewed by the City's Technical
Review Committee; Planning, Engineering and Fire have approved the proposed amendment.
Staff recommends amending the B-3 Planned Shopping Center with the following condition:
a. Final site, landscaping and lighting plans shall be submitted to and approved by the
Department of Planning and Building Services, the Department of Public Works and
the Fire Department prior to building permits being released.
Section XIII. requires the Plan Commission to hold a public hearing to review a Planned
Shopping Center District, and then forward its report and recommendation to the City Council
for final approval. A motion to forward Calendar Number 12-17 to the City Council with a
recommendation for approval is suggested.
Mr. Kent Newton said the petition states there will be four (4) stacking spaces and the staff
report says five (5). Mrs. Stewart said there will be five (5).
