1 <br /> Excerpts from Plan Commission Minutes of November 3,2011: <br /> Cal. No. 11-40 Petition of PHILLIP B. AND KATHLEEN M. <br /> NIEBRUGGE, to rezone property located at the <br /> northwest corner of WEST LEGION DRIVE AND <br /> SOUTH TAYLORVILLE ROAD from B-2 <br /> Commercial District to R-1 Single Family <br /> Residence District. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site is 3.08 acres and is located at the northwest corner of West Legion Drive and <br /> g <br /> South Taylorville Road. The site is currently undeveloped. <br /> The petitioner proposes to rezone from B-2 Commercial District to R-1 Single Family Residence <br /> District in order to construct a single family home. The petitioners also own the property to the <br /> immediate east and plan to build a retail glass and mirror beveling shop on the lot. If this land to <br /> the east is developed it will be required to provide a buffer yard to the residential districts/uses if <br /> the rezoning is approved. <br /> The surrounding zoning includes the county to the north and west and B-2 Commercial District <br /> to the south and east. The Decatur Urban Area Land Use Plan shows the subject property as <br /> Residential Low-Density. It also shows the areas to the east and west as Residential Low- <br /> Density. The proposed use is compatible with adjacent uses to the south, west and north. The <br /> rezoning of this property to R-1 Single Family Residence District should not have an adverse <br /> effect on the surrounding area. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing on a rezoning request, and then forward its report and recommendation to the City <br /> Council for final approval. A motion to forward Calendar Number 11-40 to the City Council <br /> with a recommendation for approval is suggested. <br /> Phillip and Kathleen Niebrugge were sworn in by Mrs. Poland. <br /> Mr. Niebrugge stated they would like to build a home on this property. He and his wife also own <br /> the next lot and plan to build their glass business on it. They would like to have their home next <br /> to their business. <br /> There were no questions and no objectors. <br /> It was moved and seconded (Dial/Smith) to forward Cal. No. 11-40 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
