DEVELOPMENT SERVICES MEMORANDUM
No. 11-61
November 16, 2011
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Billy Tyus, Assistant City Manager
Suzan M. Stickle, Senior Planner
Joselyn A. Stewart, Transportation Planner
SUBJECT: Rezone from B-2 Commercial District to R-1 Single Family Residence District
for property located at the northwest corner of West Legion Drive and South
Taylorville Road
SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning from B-2
Commercial District to R-1 Single Family Residence District. The City Plan Commission voted
5-0 to recommend approval of this petition at the November 3, 2011 meeting; the minutes of the
meeting are attached.
BACKGROUND: The subject site is 3.08 acres and is located at the northwest corner of West
Legion Drive and South Taylorville Road. The site is currently undeveloped.
The petitioner proposes to rezone from B-2 Commercial District to R-1 Single Family Residence
District in order to construct a single family home. The petitioners also own the property to the
immediate east and plan to build a retail glass and mirror beveling shop on the lot. If this land to
the east is developed it will be required to provide a buffer yard to the residential districts/uses if
the rezoning is approved.
The surrounding zoning includes the county to the north and west and B-2 Commercial District
to the south and east. The Decatur Urban Area Land Use Plan shows the subject property as
Residential Low-Density. It also shows the areas to the east and west as Residential Low-
Density. The proposed use is compatible with adjacent uses to the south, west and north. The
rezoning of this property to R-1 Single Family Residence District should not have an adverse
effect of the surrounding area.
POTENTIAL OBJECTION: There were no known objectors at the Plan Commission
Meeting.
INPUT FROM OTHER SOURCES: The rezoning has been reviewed by the City's Technical
Review Committee; Planning, Engineering and Fire have approved the rezoning.
STAFF REFERENCE: Any additional questions may be forwarded to Joselyn A. Stewart at
424-2782 or at jstewarte,decaturil.gov.
BUDGET/TIME IMPLICATIONS: None.
