(h) One-hitters. <br /> C. This Section shall not apply to a person who is legally authorized to possess <br /> hypodermic syringes or needles under the Hypodermic Syringes and Needles Act. <br /> D. Drug paraphernalia as defined herein, seized by police officers pursuant to an arrest <br /> or issuance of a notice to appear for a violation of this Section, shall be forfeited to the City of <br /> Decatur upon a conviction for violation of this Section, or upon payment of a minimum fine in <br /> settlement of said violation pursuant to Chapter 29, Section 11 of this Code, without further <br /> order of the Court. <br /> 27. LITTERING. <br /> A. It shall be unlawful for any person to dump, deposit, drop, throw, discard, leave, <br /> cause or permit the dumping, depositing, dropping, throwing, discarding or leaving of litter upon <br /> any public or private property or upon or into any river, lake, pond, or other stream or body of <br /> water unless: <br /> (1) the property has been designated by the State or any unit of local <br /> government for the disposal of litter and the litter is disposed of on that property in <br /> accordance with the applicable rules and regulations of the Pollution Control Board <br /> and Illinois Environmental Protection Agency; <br /> (2) the litter is placed into a receptacle or other container intended by the <br /> owner or tenant in lawful possession of that property for the deposit of litter; or, <br /> (3) the person is acting under the direction of proper public officials during <br /> special cleanup days. <br /> B. It shall be unlawful for any person to dump, deposit, drop, throw, discard or <br /> otherwise dispose of litter from any motor vehicle upon any public highway, upon any public or <br /> private property or upon or into any river, lake, pond, stream or body of water except as <br /> permitted under any of paragraphs (1)through (3) of Section A. <br /> C. Whenever litter is thrown, deposited, dropped or dumped from any motor vehicle not <br /> carrying passengers for hire, the presumption is created that the operator of that motor vehicle <br /> has violated this Section. <br /> 28. RESISTING OR INTERFERING. <br /> A. It shall be unlawful for any person to knowingly resist or obstruct the performance by <br /> one known to the person to be a peace officer or firefighter of any authorized act within the <br /> peace officer's or firefighter's official capacity. <br /> B. It shall be unlawful for any person to persist in any attempt to engage a peace officer <br /> or firefighter in conversation in person when the person knows the person to be a peace officer or <br />
