ORDINANCE NO. 2011-70 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 43 —FIREARMS - <br /> - CHAPTER 44—FIRE PREVENTION AND HAZARDOUS MATERIALS CONTROL- <br /> - CHAPTER 46—EMERGENCIES AND DISASTERS- <br /> - CHAPTER 48—NUISANCES- <br /> - CHAPTER 49—REMOVAL OF GARBAGE,JUNK, RUBBISH OR TRASH— <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Section 4 of Chapter 43, Article IV Sections 2, 3 A and 4 of Chapter 44, <br /> Section 9 of Chapter 46, Section 16 of Section 48, and Section 7 of Chapter 49 of the City of <br /> Decatur City Code be, and the same are hereby, modified and amended so that said Sections and <br /> Chapters as so amended shall provide as follows: <br /> 43. FIREARMS <br /> 4. PENALTY. Any person, firm or corporation who shall violate any of the <br /> provisions of this Chapter shall be fined not less than Two Hundred Fifty Dollars <br /> ($250.00) nor more than Five Hundred Dollars ($500.00) for each offense and each <br /> day a violation occurs or continues shall be considered a separate offense. <br /> 44. FIRE PREVENTION AND HAZARDOUS MATERIALS CONTROL <br /> Article IV. Regulations, Citations and Penalties <br /> 2. VIOLATION NOTICE AND COMPLAINT. Whenever a fire officer <br /> witnesses or has knowledge based on reasonable grounds of a violation by any <br /> person of any section of this Chapter, or of Section 12 of Chapter 48 of this Code, <br /> such person may be issued a Violation Notice and Complaint by the Fire officer as <br /> set forth in Chapter 29 of this Code. <br /> 3. PAYMENT OF VIOLATION NOTICE AND COMPLAINT. <br /> A. A person cited by a fire officer for a violation of any section of this Chapter, <br /> or Section 12 of Chapter 48, as herein provided, may terminate any further <br /> proceedings by the City due to said violation by making payment to the City at the <br />
