Any person, firm or corporation who shall violate any of the <br /> provisions of this Chapter shall ^� ^�� ��*�^�, be fined not less than Five Deflar-s <br /> ($5) nef more than •rwe 14undfed Dellafs ie200One Hundred Fifty Dollars <br /> ($150.00) nor more than Five Hundred Dollars ($500.00) for each offense, and each <br /> day on which a violation occurs or continues shall be considered as a separate <br /> offense. <br /> 41.1 STANDARDS FOR THE CONSTRUCTION OF FACILITIES IN THE <br /> PUBLIC RIGHTS-OF-WAY <br /> 22. PENALTIES. Any person who violates, disobeys, omits, neglects or refuses <br /> to comply with any of the provisions of this Chapter shall be subject to a fine in <br /> µc:,ord� with the penalty pfevisions of this r^ of not less than One Hundred <br /> Fifty Dollars ($150.00) nor more than Five Hundred Dollars ($500.00). There may <br /> be times when the City will incur delay or other costs, including third party claims, <br /> because the utility will not or cannot perform its duties under its permit and this <br /> Chapter. Unless the utility shows that another allocation of the cost of undertaking <br /> the requested action is appropriate, the utility shall bear the City's costs of damages <br /> and its costs of installing, maintaining, modifying, relocating, or removing the <br /> facility that is the subject of the permit. No other administrative agency or <br /> commission may review or overrule a permit related cost apportionment of the City. <br /> Sanctions may be imposed upon a utility that does not pay the costs apportioned to <br /> it. <br /> 42. CABLE SERVICE AND COMPETITIVE VIDEO SERVICE <br /> 10. PENALTY. <br /> A. In addition to the provisions of Section 7 (E), having to do with <br /> revocation of permits, any person who willfully violates a provision of this Chapter <br /> guiltyis of a,r sde fneanef and, upen eenvietion thereof shall be fined not fnor-e than <br /> TFC, dr-ed Dellafs-($200 nn); any sue-lav{lation shall eenscitute a separate <br /> offense fef eaeh sueeessive day eentinued less than One Hundred Fifty Dollars <br /> ($150.00) nor more than Five Hundred Dollars ($500.00) for each offense and each <br /> day on which a violation occurs or continues shall be considered as a separate <br /> offense. <br />
