Excerpts from Plan Commission Minutes of June 2,2011 continued:
Based on the above analysis, staff recommends approval of the amended PD Planned
Development petition with the following condition:
a. Final site, landscaping and lighting plans shall be submitted to and approved by the
Department of Planning and Building Services, Public Works Department and the Fire
Department prior to building permits being released.
b. Landscaping Plan: The previously approved American Arborvitae must be replaced by a
comparable tree in overall size at maturity.
c. Landscaping Plan: All shrubs must meet a minimum installation size of 24" in height or
spread at time of installation.
Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold
a public hearing to review the Planned Development plan and report its findings concerning the
effect on the comprehensive plan and compliance with the standards of review to the City
Council. A motion to forward Calendar Number 11-16 to the City Council with a
recommendation for approval is suggested.
Mr. Matt Dial asked if the new addition would be a one story unit. Mrs. Stewart said yes. Mr.
Dial remembered the neighbor, Mr. Casey, having objections when this was first brought to the
Plan Commission in 2010. Mrs. Stewart said she believes the petitioner has been in contact with
Mr. Casey and the representative for the petitioner would be able to address this.
Mr. Bob Dean, representative, was sworn in by Mrs. Poland.
Mr. Dean said to clarify Mr. Dial's question, Mr. Casey's objection was to the three (3) story
Supportive Living Facility. The Memory Care Facility will be one (1) story and the future
addition
will be one (1) story. The Memory Care was to be forty-three (43) feet from the back property
line and with the addition they have elevated some of the parking and the drop off area in the
front. They have kept the building as far north as they can and it will now be thirty-seven (37)
feet from the back property line. Steve Horve has met with Mr. Casey and went over everything
with him. Mr. Casey indicated he would not object to the proposed amendment. There has been
an agreement between the developer and Mr. Casey that several of the mature trees will be left in
place to help block the view of the three (3) story building.
Mr. Dial asked if there would be an issue with the detention area. Mr. Dean stated the detention
basin was to originally drain over land into Big Creek and strong efforts were made to get an
easement from one of the property owners, Mrs. Sherman, as there was a design to run the
drainage underground. Mrs. Sherman sold the home before the agreement could be signed and
the current owners declined to sign the agreement. The drainage will be above ground which
was the initial plan.
There were no objectors present.
It was moved and seconded (Peck/Kent) to forward Cal. No. 11-16 to the City Council with
recommendation for approval as presented by staff. Motion carried unanimously.
