ORDINANCE NO. 2011-02 ORDINANCE AMENDING ZONING ORDINANCE - ZONING BOARD OF APPEALS - - SIGNAGE IN ALL ZONING DISTRICTS - WHEREAS, on the 6th day of January, 2011, upon due notice, the Decatur City Plan Commission held a public hearing upon the request of Greg C. Crowe, Assistant City Manager, to modify and amend the Zoning Ordinance of the City of Decatur, the same being Ordinance No. 3512, as amended, and, WHEREAS, the Decatur City Plan Commission did reports its findings and did recommend that said petition be granted and that the Zoning Ordinance be so modified and amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and approved. Section 2. That Section XXX B of the Zoning Ordinance of the City of Decatur (Ord. No. 3512 as amended) be, and the same is hereby, amended and modified by adding the following so that said Section XXX B as so modified and amended shall provide as follows: XXX. ZONING BOARD OF APPEALS B. POWERS AND DUTIES 9. Electronic Message Unit Signs The Board may grant variances to the required setback for an electronic message unit sign. The variance granted for the setback shall not reduce the minimum requirement by more than 50 percent. If a variance is granted, the electronic message unit shall only operate between the hours of 6:00 a.m.
