and 11:00 p.m. Before approving any request for a variance, the Board <br /> shall consider: The effect of the variance on the City of Decatur <br /> Comprehensive Plan; whether the variance will create a safety hazard or <br /> exacerbate an existing safety hazard; and, whether the variance will be <br /> detrimental to the overall health, safety and welfare of the City as a whole, <br /> or any neighboring property. <br /> Section 3. That Section IX.A.9, Section X.A.6, Section XI.B.9, and Section XII.A.17 <br /> be, and the same are hereby, amended so that, as amended shall provide as follows: <br /> Day care center: A fenced, outdoor play area shall accommodate 25 <br /> percent of the licensed capacity at any one time. A minimum area of 75 square <br /> feet per child for the total number of children using the area at any one time shall <br /> be provided or 800 square feet, whichever is greater. <br /> Section 4. That Section XXV.13.15 be, and the same is hereby, deleted, and renumbered <br /> accordingly. <br /> Section 5. That the Zoning Ordinance of the City of Decatur (Ordinance No. 3512 as <br /> amended) be, and the same is hereby, amended so that, as amended shall provide as follows: <br /> SECTION XXV.C.2.a by replacing the term "Lot" with "Frontage" <br /> SECTION XXV.C.2.b <br /> Maximum Area per Sign: 50 square feet, properties containing five (5) acres or more <br /> may have a maximum area of 75 square feet. <br /> SECTION XXV.C.2.c <br /> Maximum height: Ten (10) feet, properties containing five (5) acres or more may have a <br /> maximum height of 15 feet. <br /> SECTION XXV.D.2.a <br /> Number per Frontage: One (1). <br /> SECTION XXV.D.2.b <br />
