Page 2 of 4 <br /> City of Decatur Zoning Ordinance <br /> January 6,2011 <br /> DESCRIPTION <br /> Amend SECTION XXX.B. (Zoning Board of Appeals-Powers and Duties) by adding: <br /> "Electronic Message Unit Signs <br /> The Board may grant variances to the required setback for an electronic message unit sign. The <br /> variance granted for the setback shall not reduce the minimum requirement by more than 50 percent. <br /> If a variance is granted, the electronic message unit shall only operate between the hours of 6:00 a.m. <br /> and 11 p.m. Before approving any request for a variance, the Board shall consider: The effect of the <br /> variance on the City of Decatur Comprehensive Plan; whether the variance will create a safety hazard <br /> or exacerbate an existing safety hazard; and, whether the variance will be detrimental to the overall <br /> health safety and welfare of the City as a whole, or any neighboring property." <br /> Amend SECTIONS IX.A.9. (R-6 Multiple Dwelling District), X.A.6. (0-1 Office District), XI.B.9. <br /> (B-1 Neighborhood Shopping District), and XII.A.17. (B-2 Commercial) by adding: <br /> "...accommodate 25 percent of the licensed capacity at any one time." <br /> "...for the total number of children using the area at any one time shall be provided..." <br /> And by deleting: <br /> "...be provided with..." <br /> These subsections will now read as follows: <br /> "Day care center: A fenced, outdoor play area shall accommodate 25 percent of the licensed capacity <br /> at any one time. A minimum area of 75 square feet per child for the total number of children using <br /> the area at any one time shall be provided or 800 square feet, whichever is greater." <br /> Delete SECTION XXV.B.15 (Signage-Street Frontage) and renumber accordingly. <br /> Amend SECTION XXV.C.2.a (Signage-Signs in Single and Two-Family Residence Districts) by <br /> replacing: <br /> "Lot"with"Frontage". <br /> Amend SECTION XXV.C.2.b (Signage-Signs in Single and Two-Family Residence Districts) to now <br /> read as follows: <br /> "Maximum Area per Sign: 50 square feet, properties containing five (5) acres or more may have a <br /> maximum area of 75 square feet." <br /> Amend SECTION XXV.C.2.c (Signage-Signs in Single and Two-Family Residence Districts) to now <br /> read as follows: <br /> "Maximum height: Ten (10) feet, properties containing five (5) acres or more may have a maximum <br /> height of 15 feet." <br />
